Question

What are the gradients of fines/points/bans for speeding on motorway?

I thought it was anything up to 80mph and no bother, points between 80 and 100 (is it 3, 6 or something else) and anything over 100mph was an instant ban....

Question based on normal motorway speed limit, not 50mph contraflow

I reckon you'll be looking at a 1 month ban and up to a £500 fine.

I got 'nicked' 5 months ago and I'm still waiting for the inevitable court date!!

Hi
My mate has just been in court for speeding. He was pulled over by unmarked bmw on the A22 dual carriageway. He was clocked at 104mph
He got 6 points and £450 fine.He had never had any points on his licence and has been driving for about 15yrs.He was told by his breif he was very lucky. So you got to look on the positive side and hope the judge is in a good mood.
Good luck

apparently i dont have to go to court, i can just plead guilty when the summons comes in.
if i take it to court they'll see the video evidence - and it wont make for preety viewing.

Normal criteria for motorway speeders is 80-95mph a fixed penalty ticket £60 fine and 3 points. 96-99mph you have to go to court, likely to get bigger fine and between 3-6 points. 100mph and over the magistrates will consider a ban. For 105mph you should get 14-21 days, 3-6 points and a means tested fine. However, as its your first offence, you may be able to plea bargain no ban in return for a heavier fine. For 100mph and above, you have to attend court because the court shouldn't ban people in their abscence. (Dont try and be clever by not turning up, because they will just adjourn the case and then give you costs as well)

I got banned for 7 days for doing 90.18 in a 60.
Plod said because i was 30 mph over the speed limit i would be looking at a automatic ban.
6 points and £200 fine as well.

Why, what else were you doing? Was it simply a case of you driving quicker than you should have been on an otherwise deserted motorway, or would the video show aggravating factors?

greasemonkey,

aggravating factors is a good way of putting it.
i wont go into the incriminating details but i'll just say that
they couldnt have hoped for a better reaction, must have been pi**ing themselves at how stupid i was.

needless to say i feel like a complete tosser.

i'v heard stories of ppl not using solicitors & doing the didnt wana waste yet time im guilty apology & kiss *** not waste court time thing with good results but that is all hearsay i think i'd wana brief still. What's this talk of bans & points i thought it was either or as many ppl say they'd prefer a ban as points stay with ya for years whereas the ban is done & dusted once its over or have i got that wrong?

but i suppose it depnds on circumstances like time of day and amount of traffic.

good luck loon but id say expect the worst then u can not be dissapointed. take it you ask for calibration?

beg to differ, a ban is the worse thing to have on your license, points are becoming less and less of an issue because more and more people have them! My wife was banned for 10 days with no points and it was an absolute nightmare with insurance companies.

You can plead guilty on the form if my memory serves me correct and then you submit it, the court will then decide whether they want to see your sweaty *** in court or not. If they write back saying they wanna see you it means that they want to kick that same sweaty backside in person

in this event I would suggest you get a solicitor.

Did you see the video? Maybe there wasn't one fitted.
Presumably they showed you your speed on a digital display. If so then this is Vascar, which calculates an average speed over a certain distance. ACPO guidlines say that the vascar should be calibrated at the start and end of every day. This is done by checking it over an exact distance. If you want to be clever, you can ask them to produce the head unit at court, as it has a memory and can show if this was done or not. The machine is affected by tyre wear etc, so if they had a puncture mid shift, it will be way out. However, they are more likely to show the video if there was one, if you do this.
Incidentally, if you plead guilty, I doubt very much if the video will be shown at court.

If you believe you got off lightly then the best route would probably be to get a solicitor with experience in traffic law to put your case to the court. As you point out it may not be to your advantage, in this case, to see the video in court.

If they were in an unmarked car and came up behind, flashed the headlights etc. and you pulled away from them then I would certainly discuss this with a solicitor before entering a plea.

A good solicitor with experience in this area is not likely to be inexpensive with the well known ones charging around £700 for a guilty plea but the savings in insurance may easily pay for this in a year should you escape a ban.

Good luck.
