Got offered another job today, yay!
I am planning to hand in my notice to the toss pot I "currently" work for (been there 8 long years) but I would like to know if he has to pay me for the holiday days that I have not taken for the past year on top of my normal salary for working the 30 days notice??
I'm not sure where I stand as some people have said he has to others were not so sure?
Any advice most welcome

If you have accumulated 30 days and not used any then they must pay you a months pay ontop of your last salary...
You earn't it, they cant not give it to you. I think that is law!!

At my current workplace, if an employee hands in their notice, they can either;
1. work the contracted notice period and be paid for outstanding holiday days.
2. work the contracted notice period minus the outstanding holiday days.
The number of outstanding holiday days is worked out pro rata through the year. e.g. An employee is entitled to 26 days holiday a year, which begins on Jan 1st every year. Thus 1 days holiday is accrued every two weeks.

Scott Herts - Sorry might of not been to clear, I have 24 days holiday a year as I have been there 8 years etc. The 30 days I mentioned was my notice period that I have to give.
Scotty Boy - I take my holiday from May to May as thats when I started, I don't think my boss really knows what or how many days I have had anyway so I will have to make sure first![Smile](https://www.scoobynet.com/images/smilies/smile.gif)
I think I have about 4 days holiday left before May of this year, then I will start the next 24 days for the coming year.
I am due to start my new job on the 1st March but I am on Holiday on the last week of feb so what is the deal there? take it he still has to pay me as I booked that time off a few months ago?
So I will really only be working for 3 weeks (at the office) and my last week of my notice period I am on holiday anyway??

stiscoob - OK, again just from my current experience;
You are entitled to 24 days per year, thus 2 days per month, approx 1 day per two weeks.
You want to leave at the end of Feb 2004. Thus you have acquired 10 months of holidays (May 2003 to Feb 2004), which equals 20 days.
You say you have 4 days left. Thus you have actually used all of your accrued holidays - 20 days in 10 months. As such, your existing booked holiday should be paid and you will only work 3 weeks of your notice period and have one on holiday.
