Insurance dispute, 350 out of pocket, what can I do?

Bloke, correction, a F***ing Retarded C***jockey
Drove into the back of me last year. the repairs were done and I had to pay the excess. 350 quid. Today I received a letter saying he's disputing it, saying I rolled into the back of him as according to him I was on a speed bump. The truth is I had cleared the speedbump and he drove over it and into me. They are asking for witnesses and I have none, what else can I do to get my money back? Apart from go round to his address (which he gave me

it was a nissan bumper. it was actually 800 quids worth of damage, but insurance took care of the rest, I had to pay the excess.

He should have got his £350 excess back from the insurance co after the repairs were carried out.
If he went into the back of you, then I thought it was a closed case-it was his fault, especially as he has no witnesses to back him up.
Rodders - do you have legal protection on your insurance - it may be worth going through them.

How is it that the repairs were carried out before it was all agreed whose fault it was?
Can't see how he can claim that sort of damage was caused by rolling backwards as you said. Make sure your insurance company does what they are supposed to and protect you from this.

No the repairs were approved and the car was returned to me. it was 800,but to get the car back I hadto pay 350,my excess. I'm trying to claim the excess back and i receive this letter saying that it is my fault and implying that I wont get my excess back unless I prove it was his fault.

If your insurance paid for the repairs, i.e. it was your claim (and your NCB gets dented, unless protected), you'd be expected to pay the excess.
If your insurance claimed from his insurance successfully, i.e. it was his fault and your NCB is OK, he should also pay the excess.

who sent the letter? You insurance company? If so, serve unto them a plate of frothing rage making it clear that you do not accept liability under any circumstances and that they are to persue the other party for all costs... at all cost. If you have legal cover now is the time to envoke the lawyer drone and make it clear to him also that you don't accept liability.
In virtually all cases it is the driver behind that is at fault despite what pathetic lies they come up with - ask them why should your case be any different!
