Default Bus lane fine, £50!!!!!!

My sister just got a £50 fine through the post for using a bus lane, £100 if not paid within 14days. Says there is video evidence. Is it worth appealing against it or is there any trick to get round it?

Any help would be appreciated

perhaps she shouldn't have "alledgedly" driven in the bus lane?
or
I'd ask for the video evidence......

The trick is to drive in the lane that isn't a bus lane. Tell her to claim she doesn't think she was in that area on that day and ask for the video.

I'm with you Chrissy. If we cause the camera folks loads of trouble all these cameras would vanish

Hmmm, never works like that though does it? People refused to identify who the driver was when they got a NIP so they changed the law so that you could be prosecuted if you didn't say, and be prosecuted to the same extent as the offence for which you will not identify the offender (although the legality of this is questionable to say the least).

Bit like walking down the street and seeing somebody getting mugged and you then getting prosecuted for ABH becuase you couldn't tell the police the name of the person who actually did carry out the mugging.

Keep the hassle going with the camera bods and by the end of the year, vehicle offences will come under the prevention of terrorism act and they will be able to hold you indefinately without charge, for jumping an amber light.

LOL ollyK ....... True

you have to admit if we all ask for Callibration certs / Pictures / Video the amount of profit in it for the Police will plumit because of all the paperwork chasing the will have to do. I say push EVERY ticket right to the end then pay up. If you did it you did it own up in the end. But you can do your bit to halt the growth of cameras

Trouble is the usual Police response is: "We are unwilling to provide that information unless you intend to take the matter to court. If yuo choose to take this to court then we will ensure that you are provided with copies of all the evidence against you prior to the court date, however, if you go to court and are found guilty, your sentence will be higher than the standard fine"

This saves them having to worry about putting all the stuff together unless you are prepared to go to court. It is very wrong and needs sorting out in my opinion. The evidence should be sent to you along with the NIP. They could not get away with this kind of approach with any other "crime", they just know most people will cough up the fine rather than try and contest it in court and risk a higher fine and more points.

As we know, people have challenged it when they are damn sure they are in the right and it is becoming more apparent that the cameras etc are not reliable or accurate, the problem is, are you prepared to take the risk?

You may want to check that the bus lane is actually legal!!

See http://www.abd.org.uk/pr/366.htm for a similar tale.

we have people working in London who have been fined when in bus lanes for 10's of seconds timed on video eveidence where a vehicle has stopped to turn right and they have passed it on the inside instead of queuing pointless no bus in sight either.

In fact they frequently put in Bus lanes on what were red routes so how could it be justified to keep both lanes moving then and now totally remove one lane?

Also who pays for the road removed to be a bus lane? why the motorist of course as we susbsidise every bus seat empty or not.

it is another tax efficient way of creating congestion to then justify anti car measures like the congestion charge
