Default Mobile phone when parked

If I park up (legally) and use a mobile phone in my car, is this legal under the new regs and do I have to turn the engine off?

from what i remember, if the engines still running, you can still be fined- so to be safe turn the engine off.

to be honest though the new regulations dont seem to hav any effect, like today i saw a lorry driver turning onto a narrow road with phone in one hand whilist reversing and allsorts!

but in the eyes of the law the only legal use of a phone in a car is to report an emegency and it is not safe or suitable to stop or parked up with the engine off.

I'd expect a policeman to show some discretion if it was clear that I was parked up, handbrake on etc. Oh, well, guess I'll turn off engine from now on. Should I take the keys out too

It's a bit like the 'drunk in charge' question when you've no intention of driving.

The law is useless....it's made no difference.

Laws are worthless if not enforced. Everyone knows that and that's why they carry on regardless.

Yes it has had some effect on reducing the number of people using their phones but i have still seen people including Police using phones when behind the wheel

LOL I can just imagine pulling over to make that emergency call, then waiting 2 minutes for the turbo timer
