12 point ban - Does it need to be within 3 years or 4?....

IIRC For 3 years the ban is in effect, but it stays on your license for 4
Edited to add that this is for normal points. I had 4 points on mine and couldn't remove them from the license until 4 yrs after the date of the offense (not the conviction).
Not sure if it's different if you reach 12.

points cannot be removed from your licence until:
4 years after the date of offence for minor offences NOT resulting in a ban
4 years from date of conviction for offences resulting in a ban or major offences such as dangerous driving.
You can ring the DVLA for clarification on specific points/dates on your own licence.

1. Endorsement Guide
Disqualifications, convictions and acceptance of fixed penalties payments in respect of driving offences are notified to DVLA by the courts. The details are entered on to the driver's record and the licence. In addition to paying a fine/fixed penalty the drivers licence will be endorsed with a penalty ranging from 3-11 points or a period of disqualification will be imposed, depending on the seriousness of the offence.
Any driver who incurs 12 or more penalty points within a 3-year period faces automatic disqualification under the under "totting -up" system.
Information on a driver's entitlement and endorsements are sent to courts and police on request.

I had 6 from 3.5 years ago, just got 3 for 36 in a 30 when my radar detector was in the glovebox and am worried about getting another one through in the next week. (Camera van facing cars ona bridge over an A road that wasn't detected by my radar/laser detector)

36 in a 30 ? The ACPO guidelines state 10% plus 5 mph OVER the limit. That makes it 38. You are a fool and should have contested that one in court. No speedometer in any motor vehicle is THAT accurate. What do they expect you to do, get your speedo calibrated every week?

As far as I'm aware you can top all the way up to 12 points, get a ban of say 6 months and be back on the road with no points!
Happened to my old boss about a year ago after being followed in excess of 120mph for over 2 miles on the way home (he blamed it on the VAT inspection ongoing at the time!)

I once had 13 points in total on my licence - which I would thave thought should have equalled a ban - but they never said I was banned and to be honest, I never asked, so just kept quiet about it. I got myself a duplicate licence at 8 points (before the next 5) which I used for insurance puroposes - don't think I would have had much joy when telling the insurance company I had 13 points.
But I was younger then and foolish...It's not big and it's not clever....

Worth knowing that if you recieve more than one "endorsement" as a result of the same conviction, only the largest ONE counts for the ban.
e.g. Get stopped for speeding, get 2 bald tyres and a brake light lobbed in for free (all at the same time). Court gives you 4 points for speeding and the others are 3 each. You've got 13 points on your license but ONLY 4 count for totting up.
I once had a total of 17 with only 11 counting for totting up so I escaped the ban.
