Did you have legal representation?
I thought we had established the following:
1) No one was injured, hence no need to report to police
2) It wasn't your fault anyway
3) There was no damage
So how they hell did you end up with 5 points? That's disgraceful - phone the papers.

the other bloke involved apparently had £150 of damage (so I found out today), but then again, I got my repairs quoted yesterday and it came to £35 + £23 VAT and £100 for labour - £158 altogether, for an alloy and a wing mirror touched up.
Didn't get a solicitor, although wished I had one this morning even if it was just for backup.
According to the guidelines, I've got off lightly... the judge accepted my explanation that I thought a clash of wing mirrors didn't require police involvement.
Narks me that last year the girlfriend had someone pull out on her and rip the back bumper off, she phoned the police and was told "we're not interested if no-one's been injured". A little consistency would have been nice but the system won't accept that it can get it wrong...

It is ridiculous. Are we really legally expected to report any accident to the police? When someone rammed me from behind we exchanged details but neither of us informed the police. Should I hand myself in?
Why has the bloke who caused the accident not been done for something?
Why are cases like this wasting the courts' time?
Why did the bloke make such a fuss over it when he could have got off without paying for your damage?
You seem to be taking this surprisingly well. I would be on the war path.

I plan on getting in touch with police to see if any charges were brought against him such as due care & attention or better still - dangerous driving - because if i hadn't reacted as quickly as i did and been in car without ABS then it would have been a head-on collision.
I am on the war path - if the other bloke got away with nothing then i will not be a happy hippy. I just hope he has full no claims and doesnt have them protected, the to55er.
5 points is a bit harsh though, when you're innocent and just wanted to let it drop... ;(

Not wanting to put ideas into your head
but if I was the victim of such injustice I would be working out the true value of the 5 points, the fines and the heat ache to me. I would then divide that up pro rata between those responsible and would be looking to "extract" similar value, through one way or another.....

5 points is an unneccessary and disgraceful penalty. It is all wrong that insufficient weight was applied to the circumstances of the accident and that it was not your fault in the first place. Sounds like they handed out as many points as they could without banning you. I think the police should have shown a bit more discretion too.
