Speeding Question
Now my mates little brother has a skyline - today he got caught doing an average speed of 120mph with a maximum speed of 160mph.
Now we all know he is an idiot for doing these speeds etc, that isnt in question.
Obviously he is in for some serious trouble - I have advised him to speak with a solicitor now rather than later.
They police pulled him over and showed him the video.
At these speeds is it unheard of for him to be given a sentence or suspended sentence along with a big fine and losing his licence. Or will this just be the fine and licence removal?

I hope for his sake that the judge is lenient and just fines him a lot and bans him for a year or two.

were all doing approx 500mph as we speak, and are all still living and breathing
so that kills that crap stone dead!!!!!
back to reality..

It is possible that we have concrete evidence that if you go faster than the man with the red flag then you don't actually die. This will come as a shock and the government could be in big trouble after this discovery.
The bad news is that he really is likely to go to jail for this one, assuming the figures you quote are correct and are detailed in the paperwork. It would probably be better if he didn't discuss the matter with anyone but got legal representation ASAP. He needs to get himself a solicitor who is an expert in motoring matters and not just some general bloke who spends all his time doing divorces or selling houses.

John Josephs is probably one of the leading experts in motoring law and in such a high profile case the expense might be worthwhile. However, this will not come cheap but he needs to set that against the possibility of loss of job and a period in jail. The government/green/PC groups will be circling this case like vultures looking for someone to be "made an example of" if the figure of 160mph was actually recorded.

However you are basically right, he needs a solicitor first thing Monday morning and he needs someone who knows what they are doing if the police are claiming 160mph. He also needs to be thinking in terms of £5,000 - £10,000 for his defence.

Your mates little brother may be lucky that it was a police car which stopped him. I think that if the police recorded his speed from a moving vehicle the maximum speed they can do him for is the average speed over a fixed distance, or 120 mph in other words. IF that is all they charge him with, he can expect something of the order of a 8-12 week ban and a big fine. The details are also important, if it's 119.5 mph they charge him with then he will be looking at a 4-8 week ban, they have sentencing guidelines which change at 10 mph increments. For reference I got done for 116.5 mph, 6 week ban and 300 quid fine.
However that's the end of the good news. If they have video evidence to show that he was driving dangerously (and speeding at very high speeds does not necessarily equal dangerous driving http://bbs.scoobynet.co.uk/showthread.php?t=378550) then they will throw the book at him.
He does need to get himself a good solicitor, but £5,000 - £10,000 ???? Who's he retaining, Rumpole of the Bailey? If it's a magistrate's court then the cost will be approx one tenth of those prices. Of course if he wants to take it to the European Court of Human Rights, it'll cost a bit extra

Most of the good motoring solicitors are currently charging in the region of £750 - £1000 for a guilty plea (i.e. just to make a plea in mitigation.) If they try it on with 160mph then he may get advice to go not guilty and may require expert witnesses to analyse the video evidence etc. It is also a distinct possibility, in the case of 160mph, that the case would be heard in a higher court.
The case which led Mike to set up the pepipoo site, for example, was quite similar in that he was followed by a police car recording video evidence and was, eventually, convicted of the maximum speed recorded by the police car. It could be clearly seen from the video that he never achieved this speed in his vehicle, it was the maximum speed of the police vehicle. So, with this in mind there is a possibility that the summons may be for 160mph.

the 2 bikers that hit the headlines in summer (2003 I think) got a prision sentence, they got caught for 147mph and 157mph
I guess it depends if theyve nicked your friend for doing the 120 average or the 160 maximum.
just as well he was caught by a copper and p'haps getting nicked for the 120 average, rather than the 157 the camera operator nicked the bikers at...

I'm pretty sure there were other factors in the case of the two bikers. Weren't they recording on-board video from their own bikes and that was seized as part of the evidence? If i remember correctly they were done for dangerous as well as the speeding, wheelies/overtaking etc.
