Default speeding ticket

Got a speeding ticket in the post and need to name the driver.

My mate might agree to be the named driver as he does not care about points. Will he, or I, be asked to prove that he was insured to drive my car. Obviously he was not insured, as was he not driving.

Any ideas?

I wont comment on the legality of this; there will be many a sanctimonious troll along soon to do that.....

A lot of this goes on, typically with students taking the hit; it certainly isnt common practice to see whether the named driver was insured.

how can they prove it was you the car could have gone for a mot ,repairs

How about you take the points yourself, as presumably it was you who committed the crime?

Not sure its being sanctimonious, nor trolling. I'd certainly never admit to a crime I didn't do, likewise, I'd never ask a mate to do the same for me.

Well its between him and his mate really, if his mates willing to take the points fair play ! He might have done a big favour in the past for his mate we cant judge...

All they want to know is who was driving and their details mate, they wouldnt ask for inshurance etc ! but obviously im not saying do this as this is illegal just advising on their process...

But if you didnt have a mate and if it was a camera that flashed you....well post back and we will go from there....
1) Say you cant remember who was driving and would they be kind enough to show you the picture

2) Ask for a caliberation certificate for the camera

Chances are you wont get away with it but defo worth a try or do the honest thing and take the points (less fun)

Yeah, probably will just be honest, but wanted to know the normal legal requirements/processes.

Doing 81 in a 70! I will have to be more careful!

If you name another driver more than likely you will be asked to provide insurance details for the named driver.

If you fail to name a driver, they will charge you an MS90 for non-declaration. This carries effectively the same level of points and fine as per the original offence.

They dont ask you for a named drivers insurance details any more than they ask for yours.

Speeding is hardly a crime is it. Speeding fines are merely another tax, so if someone else offers to take the points so what.

It amazes me how many do gooders there are on SN, supposedly a motoring forum for car enthusiasts. Next week you'll be asking for a 12 month prison sentence for anyone exceeding the speed limit!

I also got notice of being flashed by camera on wednesday..46mph in a 30.....pisses me off slightly cos the part of the road i was on is always quiet..and it was at 1.30 am!

oh well...just need to take it on the chin i suppose...just annoyed as its first time!

Generally they only ask for insurance details if you name someone who lives in a different country, basically if you use that one to get out of paying, they do you for allowing someone else to drive the car without insurance or something, or at least threaten you with that.
The camera partnerships would generaly prefer to extract their £60 from someone, as they get to keep that, than see it in court in which case they dont get to keep the money.

81 in a 70 is definately within the "conditional offer" range, if there isn't one on the back of your NIP there will definately be one after someone admits to driving.

With the number of speedcams and "road safety" partnerships around now, it just does not not seem worth while speeding. It looks increasingly as though you will be fined for not very much over the limit now, even the ACPO 10% + 2 doesn't count for anything in some places now.

The points can mount up so quickly that it does not appear to be worth risking your licence for any more. With the accent on making as much cash as possible out of the motorist they will seize on every chance to get you. It does not do any good to say that there was no traffic on a clear road etc., they have the whip hand and will take the money and hand out the points with a smile!
