Default IS THIS SPEEDING FINE VALID?

It's actually my brother who got caught speeding on an empty (no excuse I know!) M62 in the early hours of 13th August 2005, he got clocked at 119 mph!

Anyway he only got the ticket through the post a couple of days ago, and it was dated 3rd november?!?

I was led to believe they had to contact you within 30 days or something similar, is that correct or is he going to get the book thrown at him regardless?

Duuuuuude. If you know that the motorway being empty is no excuse, why is it mentioned at all? The amount of traffic has abolutely no bearing on the validity of a speeding ticket although there are soem on here that thinks it does .
Anyway I thought that they could have you anything up to 6 months from the date of the offence?? Im sure they'll be someone who knows the specifics.
Anyhoo with a bit of luck he'll just get a 1 year ban and ~£400 fine or something.

Was he stopped by the police at the time of the alleged offence or was he caught on a camera?

Was it in a company or lease car, or his own ?


If caught on camera, a nip (notice of intended prosecution) must be served within 14 days of the alleged offence. If the latter is the case then I suggest you pop over to www.pepipoo.com and post his details. There is a legal defence to an invalid/ time expired nip.

Shame your brother isn't a member of the constabulary or he could have done up to 159 mph to familiarise himself with the controls.

He was driving my ex-company car, anyone could drive it with my permission.

Also he was caught and stopped by the traffic police and he gave them all his details so they contacted him directly, my old company don't even know about it as far as I am aware.

at least his car licence isnt important to him.

(i assume thats the case as he went over 100mph......think how bad it would be if it was important! lucky escape for him)

Oh dear, it is going to virtually impossible to win this in a magistrates court, especially if there were 2 traffic police. GET a Traffic Solicitor before he contacts or fills in any other paperwork.

IMO an extremely well rehearsed mitigation speech might lesson the fine and even( slim chance but not unheard of)get him points instead of a ban.

He has to be careful that a charge of dangerous driving doesnt come up (possible custodial sentence) due to the speed.

If he was stopped by plod then the chances are he was given verbal Notice of Intention to Prosecute, which is enough to satisfy the 14 day limit.

This website should help your brother in the near future.

If he was stopped and cautioned etc. then the Policeman would have served the NIP verbally at the time. After that they can offer an FPT or invite him to come to one of their court shin-digs. They've got 6 months to initiate court proceedings though.
