Can BT just run cables over private property?

Angry Can BT just run cables over private property?

I came home last night to find BT have ran a cable from the house next door right over my garage and flat roof part of my house (clearance approx 6") and then right across my back path/garden and to a pole out the other side of my property.
Question is, do they have any right to do this? Can I insist it is removed?
I presume I own the airspace for at least the height of my building (much higher than said cable)
Its in a prime position to get "accidentally" damaged when I am out checking things with the ladder at the weekend.
Do companys have rights to do this? I know BT think they are a law unto themselves but is it true?

Put the ladder through it and sue them for damages.

Any cables run, should be at eaves height or higher, if there is a ponential H&S risk, you should call BT and complain,

failing that trip over said cable whilst working on said flat roof

I was wondering, did they actually come onto your property at any time without your permission? Just a thought.

Yep, must have been on my property. No way the cable could be thrown the distance. problem is I am in Scotland where tresspass laws are different/non exsistent

I would certainly not be happy about that sought of wiring but have a thought for the neighbour you are about to cut off as they may have no idea what has been done.

If you do not like the neighbour just cut it off

Cable is not attached to my property, but goes across 40% of flat roof at a height of 6" from the roof. My real problem is Can they do this?
Can I come to your house and run 6 cables back and forth across your garden below the level of your roof and you have no say in it?

Do some re-roofing and accidently put the felt over the top of it

To me it sounds wrong. Just phone BT and tell them you are converting the flat roof into a balcony and they cannot put their cable there.

You think trespass has any more teeth in England? It isn't a criminal offence, it is civil and you can sue for tresspass, but only if the person didn't have a good reason for being there (so you can't sue the postie for example).

I seem to remeber my mates parents having the same sort of problem when new houses were built out the back from them, iirc they spoke with BT and told them to either move the cable or compensate them for having a cable running through their garden albeit in the air.

Was in Scotland too.

Even if it was sub contractors, BT are still liable for their actions, because they are carrying work out on behalf of BT. I would bitch to the Nth degree tbh. Try that at my house and "oh look, some thieving pikey has nicked the wire, for the 4th time "

Just cut it and throw it over your property boundary. If they come back and do it again do the same. it is your property.

Or make a surreptitious nick in the cable where they can't see it, without shearing the cable in two... Let them figure out what the problem is.

This would be even more fun if you don't show any annoyance of them coming on your property to investigate/replace it.

Simply keep cutting away each time they replace it. They'll soon get the idea and run it around the outside of your property!

i think they need a wayleave agreement before they can install over private property, sometimes even applies if the cable they're installing is to serve the property they are crossing

Well if you start complaining prepare for problems with your own phone line!

I really cannot see what the problem, after all how often are you up on your flat roof?

Suppose you want some money for the cable, or BT to spend monmey re-routing it. Thats great let us all complain about cables and watch BT out up their prices to pay for it!

Consider yourself lucky you aren;t my neighbour who is about to have the manhole in his garden dug up and replaced, when it is about 8 ft deep and doesn;t serve his house! That is going to be a large hole and all hand dug to as no access for machinery!

Chrisgr31. Not interested in the money.
I dont think its too much to ask that they route it along with the rest of the cables along the poles at the bottom of the garden. The other half of the neighbouring house is done this way AND the cable in question was routed this way until yesterday.
IMO its just laziness and arrogance on BTs part that it wasnt done this way again

If you have to ask the question here then you just might find yourself struggling to rectify the situation.

Tell them you are not having it across your property, it's really that simple.

I have a long drive up to my property and at the road end of the drive, just inside a field was a pole that BT wanted to replace.

Sitting at my pc I heard my hounds barking at something at the end of the drive. I could see on the cctv that a Bt van was parked up. I popped down the drive only to see a bloke digging!!

When I asked him what he was doing he said "fitting a new pole". I said there was a pole 10 feet to his left in the field. He said, "yes I know but the field owner is out and we can't gain access to the field".

I then asked him why he thought it was OK to dig the edge of my private drive up then? He replied, "Oh, is this your driveway"

I then asked him to fill it back in and leave it as he found it, and wait till he can gain access to the field and replace the existing pole.

They did this and búggered off. Had I not been at home however I'd have returned home to a new pole stuck at the end of my drive-way!!

Def H & S risk as you may trip over it on your flat roof. Inform them of that and they should move it. If they don't then trip over it
