Default how long is an assault charge held on file ?

basically long story, while back neighbour assaulted and threatened wife in front of my 6yr old,

no witnesses so police nothing to go on !!!!!!!,

anyway that evening I hit him once, cut a long story short,

in court , 1st offence, good job, well dressed ,

scumbag on the dole etc etc

ended up charged with

"serious assault" and a 2k fine !!!!!!!

Not happy with system, don't want to go into it but

how long is the charge with me for

thanks in advance ,

jase

Tough break bud.

Same thing happened to a guy I know when he caught two junkies trying to break into his house.

Are you in social housing?

Punching your neighbour is a bit "Trisha guest"

A mate still has a caution for drugs on file from six years ago.

A friend served six months for firearms offences and he believes it will be on record for ten years.

A mate of a mate got turned back at USA immigration last month as he has a conviction for armed robbery from the sixties!

Therefore you are probably best appealing your conviction, or contacting someone who can tell you for sure.

And next time make sure no-one witnesses you, either! Hard luck mate!

He's already said his neighbour is scum who assualts his wife in front of OP's son. Sure the situation could have ended up with more than one punch IMO......

^ hmm since when has social status\wealth\class dictated how a person reacts to a bad situation?? (maybe a millionaire would hire a hitman :P)

if a neighbour assualted my wife (well ok i'm young and living at home.. lets say my mum :P), and it didnt get anywhere with the police, i think id punch him aswell if i saw him...and i think alot of people would!!!

Anyway if he was in social housing hed probably try and suffocate the guy with an asda carrier bag or spike his glue supply...

Ignore the above idiot, it's clear he wouldn't have the ***** to protect his own family.

Given that same situation, I doubt I'd be able to show the restraint you did.

Well I would not live in social housing....thats for sure.

Try selling a house when you have to admit to punching a neighbour

So, given a situation whereby your wife was assaulted and threatened in front of your child, you'd do what, exactly?

Try to scare them away with your pretentious ***** routine?

I'm reading this and thinking it wasn't the poster wife that got assulted, but the neighbour assulting HIS own wife in fornt of the posters child.

Either way, having a fight with your neighbour is the dumbest thing you can do.

If that is the case, I apologise for my previous comment.

I _think_ if you have less than 3 non serious offences where you dont go to prison then its 10 years, more than 3 and its 20 years. If you go to prison as a result it stays on for life. But I think it can last forever anyway if its decided that is needed.

Yes, the neighbour hit his own wife, it seems. The posters son witnessed it. I assume poster had something to say about it and it got heated. Neighbour doesn't sound nicest of guys. Either way, the OP says he doesnt' want to go into it and wants to ask a question.

Whether he is in social housing or not.....

Well even though you came off worse in the long run, you can take pride in knowing you defended your family mate. And as it was your wife, not his, he is lucky to still be able to walk!

Saw a guy do that at a party once. took off the chain started the saw and then ran through the crowd. Was funny at the time but looking back and thinking of all the screams I guess it wasnt so funny...

Would you get the same fine if you got into a fight down the local? Seems like they gave you a bit of a big fine?

You should have gotten some mates to do it one night. Would have probably done the same as you but planned a bit better.

http://www.lawontheweb.co.uk/rehabact.htm

5 years till it becomes spent. A person's offence will still remain on the Police National Computer even after it has become spent - it will not be deleted.
