Employers and Holiday entitlement
Miss Speye has just reurned to work after a fortnights break, she works in a local shop in the area.Four years at uni,and she is working in a shop.
Well the owner says she is not entitled to take her next two weeks holiday,in 3 weeks time unless she actually goes away.Because it causes to much hassle,as we are still undicided about going away he keeps asking if we are going away/.If we go away and she takes 2 weeks hols he wants proof when/where she is going
She does not have a contract and the boss keeps making silly little rules up all the time.
His last one was you are only allowed to take 1 break a day(12 hour shift) untill Miss Speye showed him working regulations and break times during shifts
Iknow he is in the wrong on this one
Any help,advise will be helpfull

You are entitled to a minimum of 21 days holiday plus statutary (sp?) if full time IIRC BUT you cannot dictate when you take your holidays i.e. if you ask to take your holiday at a certain time, your employer can refuse.

I know that noone on here likes government interference, but without it bad employers could get away with the above with no comeback.
Also we would probably still have 8 & 9 yrs olds working in factories.

Yep, and I think you'll find (as above) holiday can only be taken at managers discretion (i.e when business dictates); however saying that there has to be give and take.
Do you think it's got anything to do with your wife just having had 2 weeks off, and now wants another 2 weeks at what could be construde as fairly short notice? Some managers are funny like that..
Dependent on what info/advice is given here, I'd give the CAB a quick buzz in the morning and ask their advice.
I get 30 days + bank holidays. They generally prefer 2 weeks+ notice, but are quite flexible dependent on staffing levels etc. For longer holidays we need to give at least a months notice.

If it is already booked in, surely the manager hasn't got a leg to stand on??? And whether she goes away abroad, in this country or simply stays at home for that time, is nobodys business but hers!!! Phone CAB
