Section 59 notice
I have had a nice traffic officer here today, last thursday morning (2/8/7) an off duty police man allegedly saw me doing 90mph on the way to work and nearly crashing into various things/cars/bin wagons/ off duty policemen
this off duty policeman has made a statement, and i was given a choice, fight it in court, or take a section 59 notice
i cant be bothered to mess about in court, so just took the "warning"
i don't recall any of this to be honest, i drive like a tit at times but 7:20am is 10 mins after my alarm goes off in the morning and a good 40 mins before i start work (when on earlys) and i obviously don't get wrong for starting late as i own the bloody business
can a off duty copper say this kind of stuff and it end up with me getting a 59notice, it seams a bit fishy when it was not so long ago that another off duty copper claimed i nearly drove over him on his pushbike when i was not even in the areas, nor could the copper remember exactly where the "incident" was at the time (i made a PCCC complaint about this bloke, wondering if the "sarge" has asked a few of his chums to start hassling me)

I would have told them to prove it in court - you have, effectively, accepted that you carried out the alleged offences .... and they will now be on your record!!

yes i believe they can, it lasts for 1 year, i thought this thing was brought in to stop all the cruisers handbraking around mcdonalds car park, its a little unnerving that an off duty copper can make a statement and "it all kicks off"
especially for what would be debatable at best

Should have come to the TTS meet tonight, Micky, you wouldn't have been in for them to hassle you with it.
Personally think it's a load of crap, should have told them to prove it.

i will go into work tomorrow to see what time i arrived last thursday, this "incident" happened about 3 mins drive from work, so if i arrive at 7.23am then i must have been in the frame, still cant remember any of the tailgating, nearly hitting a bin wagon, undertaking malarkey mind...

the traffic bloke has probably been sitting waiting for me every morning since, and got bored with me not being there so called round
cant help feeling that this is open to abuse, especially after i complained about that Sargent a few months back

How on earth did this off duty officer get an accurate speed reading? Surely if they can prove this then they'd have charged you with something, so it suggests they can't.
I often see people driving badly but I imagine if I told the police after every incident they'd still do nothing, sounds like they have something against you.

I'd fight it. Fight it all the way. For all you know there is somebody else out there who has cloned your reg, which is why you are getting all this hassle in the first place.

"well yes, his road car speed is not calibrated, but its probably not that far off in real terms"
i wish i could search for my old post where i ended up complaining about the "sarge" a while back, i do think that they have just waited for the dust to settle a little bit and then started poking about just to **** me off.
its one of the reasons why i painted the car all white again as i figured i was going to start getting "hassled" after the first complaint, and a red and white painted car was just going to stand out to much, i have been followed from work to my home address before come to think of it (2 months back)

sounds like you and a couple of mates want to find him and chuck him in your boot - i know i would.
the only other advice i can think of is sell your car
not ideal, but it could be your only option.
the thing ive found with the police is just nod and agree with them and only answer answers that they wont want to hear if they are pulling your pants down about something.

cant help feeling like they "have it in for me"
the bloke who was running the wash a few years back was hassled by them loads as they wanted him to testify against one of tynesides gangs.
he wouldn't, so they used to wait for him to lock up on an evening and follow him home, pull him over for routine drink driving checks etc etc.

I'd challenge it all the futher mucking way!
The off duty moron cant prove you were doing anything illegal, he cant even prove you were there when he claims it happened.
I wouldnt bend over and take a section 59.
I'd take it court (hiring a brief along the way) and that would be that. Case closed.

dont chuck him in your boot though - another off-duty policeman might see this happen and issue another section 59.

I would fight it, surely his "word" can't be good enough without some hard evidence?
I have heard of whole cases being thrown out of court for a minute detail in the evidence not being correct so this surely wouldn't stand-up as he doesn't have any evidence or proof at all!

If you cant remember any of it AND the copper said his off duty lacky was in a non calibrated car then WHY WHY WHY would you accept all of this crap
Problem now is that you have, so IF you are innocent then you have frankly just stiched yourself up and IF your not innocent then why come on here telling us you dont remember any of it when you actually did do all that was suggested

If his speedo has not been officially calibrated then what he said about your speed is not acceptable. I really think it is terrible if they start to take advantage of their position to give you a load of hassle like that. not a lot you can do about it if they get the knife into you though!

after looking into it a bit more, it seams the officer should have been in uniform to witness the "event"
which he was not, so i have basically shafted myself in signing the thing
to be honest, i just didn't want the hassle of messing about with courts, most people who end up in courts for motoring offence type stuff always get shafted, a mate was recently trying to take on the system and only just escaped jail at the end of it (suspended sentence i think!)
checked the cctv at work, but unfortunately i was upgrading the cctv on thursday morning and all the old files are not compatible with the new card, so i formatted both HD`s before installing the program, no footage before 8:30am on thursday
dont think i can do anything about it now

imo, and in my experience, the police are very rarely out to help you. They are just out to make their job easier. They have been told to do something, and they come out with some great one liners to try and get you to sign your life away. Chances of them taking you to court would be v low, yet he managed to get you to sign with just the threat of that.
