A colleague at work has been told she's been accidentally paid a shift allowance of 12.5% for the past 4 years. Employer says they want £3300 back as she was not entitled to the allowance. she has a contract stating her pay incorporates a 12.5% shift allowance. She has worked shifts. Where does she stand? She's has an appointment with Union rep soon but needs some intermediate advice. Any takers? Cheers

She stands in a very strong position. They can re-negotiate her CoE but they cant recover a payment that she was entitled to.

A lot of contracts have the smallprint of they can claim back the money but only at a rate of £40 per month or something small like that. Get them to check out for that as a fall back too. Just in case.
