Ebay - is this fair?

I bid on and won a radio control off-road buggy which I was going to give to my son for christmas. The winning bid was a bargain (£50 for a Tamiya 1/10 buggy with radio gear & batteries) so I was very pleased as it looked in good condition and would be worth about £150 new.
I paid immediately, but a day later my money was unexpectedly refunded and the buyer said he had found a fault with the model and didnt want to send it to me with a fault that would cost £40 to fix (ESC and/or motor).
I have some spare model parts so I could easily repair it but I wasn't given the option. I told him this but he is not responding to my email.
Any ideas before the "Hightee posse" are let loose?

You need to contact fleabay, the sale is a binding transaction.

Sounds like he has got a better offer, or will relist after Christmas hoping to get more money.
If you complain eBay may send some nasty messages to him, you may also be able to leave neg feedback. However, there is no way that eBay can actually force to the item to be posted to you.
You will have to find another toy if the seller is not willing to actually sell to you.

I'd like to give him the chance to respond before posting details.
The thing that really p1ssed me off was that he didn't give me a choice of taking the "faulty" car or have a refund. It was just there and it didn't leave me time to find another decent model before xmas.
