Default Car accident question....

A lass at work had a small accident on her way to work on the 19th of Feb but her MOT had run out on the 14th. Is it the case that you're given a few days grace or is that only when your car has already failed it's mot? What is likely to happen to her as the person she bumped has already gone through insurance?

No grace. If the car is a write off the insurance company will want to see the MOT to assess value, no MOT, lower value.

If the Police are not involved, nothing else.

If it makes a difference, she has actually sold the car the day after the accident

If the accident was not reported to the police, as it should be, and they don't find out, she should be ok. If they do find out, it will be troublesome.

The insurance company will probably not pay out because they'll say the car was not mot'd and so not in a road worthy condition thus not insured. In which case she will have to pay out of her own pocket for any damages.

Contrary to popular belief, having out of date mot (or tax for that matter) DOESNT void your insurance. It may possibly void a fully comp part of any claim, but the insurer will still pay out for third-party damages. Its a legal responsibility for the insurers to do so.
