My friend was out in her new car last night when a dog ran out in front of her from a side road. She called them tonight to ask how the dog was and to ask for there insurance details as the dog has done 600 pounds of damage to her car. (the dog lost a leg)
They said they have no pet insurance and don't see why they should pay as it had never run off before
she also called round to see them and thinks there is no chance of getting any money going by the state of the house.
Any one else had this kind of problem? can she take them to small claims?

I doubt that the dog owner is insured for damage (just health insurance). It isn't anything to do with the Police as nothing 'criminal' has happened.
Your friend can hope for the good will of the dog owners or she will have to claim on her own insurance.

Dog insurance DOES usually cover damage to property inc cars, etc after accidents, however as you say they have none ![Frown](https://www.scoobynet.com/images/smilies/frown.gif)
Im sure the dogs leg coming off was not cheap.
Was there not a thread about this a few months back? Im sure there was. Cant remember the outcome.
As for financial recovery. Check with your insurer, see their take on it.

My insurance cover's me for the vets bills and and all 3rd parties inc bites and accidents. There is no chance of them paying - they have no money and made it clear they are not going to pay.
I have given her a number for claims company to call as her insurance are not that interested in helping out.

I ran over a dog a few years ago and then you HAD to report it to the police. Didn't chase up any insurance though as a) witnesses said the dog ran out in front of me so there was nowt I could do (it was a goner) and b) being an ankle biter-type dog it didn't do any damage!

I wonder if their property insurance, if they have any, might just cover this? There is usually third party liability cover so if a tile falls off your roof and kills a surgeon walking past you are covered. Perhaps this might include a dog running out and causing damage. I doubt it but you could investigate. Note if they have a mortgage then they probably do have property insurance in place as a condition of the mortgage. dl

The Road Traffic Act 1988
It is an offence to have a dog on a designated road without it being held on a lead. Local authorities may have similar bye-laws covering public areas. Dogs travelling in vehicles should not be a nuisance or in any way distract the driver during a journey.
If a dog is injured in a car accident, the driver must stop and give their details to the person in charge of the dog. If there is no person in charge of the dog, the incident must be reported to the police within 24 hours.
