Displaying Tax Disk
Quick question:
Is the offense specifically "failure to display a tax disk"
or
"no current tax disk"
I've MOt'd my car and I'm sure you are allowed to drive your car to and from the MOT place legally without a Tax disk (MOT place happens to be right by work).
I've applied for my Tax disk online as it's next to impossible to get a PO from here and it will be arriving in up to 5 days.
So, given that I have paid my car tax and have insurance and MOT am I breaking the law driving the car tomorrow?

It's failure to display the disk. You can drive to and from a pre-arranged MOT test, and to and from a garage to have the specific repairs carried out that are required to pass the MOT, but that's about it. You'll risk being pulled over if you don't actually have a valid disk in the window otherwise.

Vehicles are also exempt only when:
Going to a test centre for a pre-booked MOT test, stipulating the time and date of the relevant test.
Whilst undergoing an MOT test.
After failing an MOT test, for the purpose solely of taking the vehicle to a pre-booked appointment at a garage in order to have the faults rectified or relevant repairs carried out.

Kieran,
You can drive to a PRE-BOOKED Mot without tax, but you must have insurance.
If you have paid for a tax disc online, carry the letter with you as proof. If the DVLA & police come round taking cars away, it is my understanding that they check their systems which will show your car is taxed and you are waiting for the disc to be delivered.
If you are stopped by the police for no tax disc, you don't have your letter with you and their database has not been updated, the police send a form to the DVLA who are the ones that prosecute. They will then see that your car is taxed and cancel any further action. Just ensure your car has nothing else wrong with your car
Nige.
ETA: DJDunk also has it spot on. They are all the exemptions.

33.—(1) A person is guilty of an offence if—
(a) he uses, or keeps, on a public road a vehicle in respect of
which vehicle excise duty is chargeable, and
(b) there is not fixed to and exhibited on the vehicle in the
manner prescribed by regulations made by the Secretary of State a
licence for, or in respect of, the vehicle which is for the time being
in force.
£200 fine if I recall.

I just had the Scoob MOT'd the other week and luckily for me my next door neighbour does it as he owns his own garage, I gave him the keys and he phoned his hoppo to tell him to book my car on the system as he was about to set off

The new tax reminders have some text on the back about this, something like it being an offence to drive without a valid disc on display although you do have a 14 day "grace" period (after tax runs out) in order to apply for a new disc before, of course, they fine you for not having one
