2nd Hand Car from a garage and bad clutch judder

Hi All,
The missus has just purchased a new (to her) MX5 it’s a 02 plate.
She picked it up last Saturday and it has a 12 month warranty.
The problem is it’s developed a bad clutch judder and it doesn’t seem to be going even after some good runs.
I know this isn’t included under the warranty (as it general wear and tear) but what do you think her rights are as, she’s had it less than a week?
Yet to see what the garage says, but she’s booked it in for them to have a look on Sunday.
Just wanted to go armed with any helpful tips/words.

Rear main or gearbox first motion shaft seal leaking oil onto clutch centre plate.
Replace whichever seal is leaking and the clutch centre plate.
Would be worth replacing complete clutch assembly when you have it apart.

I belive its the face lift models that are more prone. 1.6, not so sure about 1.8. So don't quote me on that.
From the ones I've driven, I'm under the impression alot of people that drive them are unaware that its juddery, or are penning it down as an attribute of being a "British" sports car
