Default problem getting camera repaired/replaced

Hello

Just wondered where I stand on this.

We bought a Vivitar digital camera for our daughter in Jan '08, hence it is still under warranty. Last month it started playing up so I took it back to the shop that we got it from only to find that it now had different owners. The new owners were fine and said they would need to contact Vivitar to establish whether they should send it back or whether it was down to the customer. They took the camera and gave us a receipt and promised to phone me the next day.

They didn't, and for the last few weeks I've had to continually chase them. Last time I was quite firm and said that I wanted the matter resolved asap but also wanted to be kept in the picture (excuse the pun). It was at this point that the manager told me that although they were honouring sales made by the previous owners they were not legally obliged to, thus they were ‘doing us a favour.’

Does this sound right? Could they turn round and tell us to sort it out ourselves?
