Question Theoretical' sale-registration-ownership' question.

Let me use a car as an example.

Dealer sells car to purchaser-purchaser dies before being able to send off Registration docs' to DVLA.

Who has right of ownership ?
Relatives of deceased say car is theirs as it was sold and they have receipt.
Dealer says it is still registered in his name so it belongs to him. ( Assume it is registered to dealer).

Purely theoretical.

Car belongs to .....?

Contract of sales makes the purchaser the owner if the funds have changed hands.

Name of registered keeper is just that, even says on the V5 that it is NOT proof of ownership.

Receipt of sale trumps V5

Exactly as above - the purchaser is the owner - a V5 document shows the registered keeper, who is not necessarily the owner.

Look at it another way; you have finance on a vehicle, the V5 is in your name, but you don't own the vehicle until the final payment is made.

The V5 is just a document listing the registered KEEPER not the owner!!!!

It was theoretical--sort of--self and wife in discussion over tea about something she had heard about and we both thought that exchange of money was the key factor to ownership. Car was a reasonable example but the V5 is totally irrelevant to the discussion as we were not talking car.
No issue, no car and as it is her birthday tomorrow....

lol in any case, proof of sales releases the ownership of any item from the retailer. Ownership within the family is another matter lol, best left for Jerry Springer.

Surely if the car was paid for, it belongs to the estate of the purchaser regardless of the certification. The dealer is responsble to inform DVLA of the sale and change of ownership anyway. The purchaser's details would be on the form that the dealer sends in and that would have been filled in by the purchaser during the transaction.
