question about a drink driving ban
No me btw!!
friend of the family has got a nine month D/D ban,
she lost control and wrote the car off, no one hert (thank the Lord) .. a witness rang police... the rest history now.
My question...
Would the insurance pay out on the car?
Does the ban clear your license of points after the nine months?
What implications are there when you want to insure a car after the ban?
anyone had the same sort of 'problem'~?

my understanding is that;
no, the insurance company will not pay out of she is convicted of DD.
Not sure about the points
Insurance will be avaliable but much, much higher and limited choice of companies

The insurance wont pay out due to being under the influence.
points will stay on there for the usual 3 year duration, the drink driving conviction will stay on there for 7 years.
When they reinsure a vehicle after the ban duration has passed they will pay a premium on there insurance due to the drink driving ban.
Been there done it and wont go back there, when i got a ban it was cos i stopped to help someone else that had an accident, id had a couple down the pub didnt think i was over the limit but as i got in the car to drive away a copper come up to me and asked had i been drinking and took a breath sample and i failed. long story short i had to go through it all and will never be a good samaritan again

It was wrong of me but friday nights and youth happens.
It was many years ago and the sentence was not long enough for me to need to resit my test like they do thesedays

I was also under the understanding that your insurance was void if you were over the DD limit.....However, I know someone that crashed their car and were found to be over the DD limit. Insurance still paid out for his written off motor.

I don't really understand the need for a re-test? I've noticed in Ireland now 2 year bans seem to be the norm.

Now off his ban - he is getting absolutely hammered on his insurance though ! More than double the value of his car !

The lady is over a certain age - whereby she may have to sit retests regardless
The insurance will payout - presuming shes insured
The rest is dependant on her history

70 year old women shouldnt be driving, let alone under the influence, i bet her eyesight is WAY below the minimum requirement!

Her eyesight may be perfect, its her beer googles that need a new prescription.
My advice, for her would be to give up driving and use the money she saves on a car, insurance (will be massive) and running it and get taxi's and buy a push bike.

She does sound like a danger, but down to her drinking habits not due to her age, unless I have missed some irony are you really advocating people give up driving at seventy ?

My mate got caught "the morning after" and im sure he told me that drink driving as well as a few other convictions stay on your licence for 11 yrs total..
Think 5 years is for lesser convictions and tot up of points..

I know my sp30 3points were on for three years.. you can send your license off after 4 to get them removed off the paper copy etc.. i still gotta do that

It does stay on you license for 11 years. I got done 6 years ago. Got a year ban but went on an evening drive wise course which knocked 3 months off my ban so got 9 months in the end.
Insurance companies always ask if you have had any convictions in the last 5 years so even though its on you license for 11 years you haven't got to tell your insurance company after 5 years

I can't see why the insurnce won't pay up unless there is a clause in her insurance? The license will be stamped with the DD and it doesn't come off for 11years and insurance companies will count it for 10years. If she gets caught again in that 10 years its an instant 3 year ban

One of the guys I work with has just been done for DD he wasn't given a set ban he just needs to resit his test, he has been driving for less than 2 years mind.

Not 100% sure. I know he spanked it into a lamp post and in his not normal frame of mind got out and left it there, no other car etc involved. Obviously the police just ran the plates and found him the next day.

if it his her 1st drink drive the insurance will pay out no problems
if it his her 2nd/3rd etc the insurance she has in place will have a drink drive clause which automatically reduces policy cover to third party only if she has an rta.
