Future of the Internet - Google in court
Interesting case in Italy where three Google executives have been jailed as a video was uploaded that showed bullying of a Down's Syndrome boy - breaking Italian law.
If Google was to be held accountable as it provided a transmission service, wouldn't the ISPs and network providers be equally guilty?
Where does responsibility lie? And is this the thin end of the wedge that Scoobynet has been so paranoid about for years?

Interesting.
I would have said the responsibility is with whoever stores the offending data. If that data was stored in a country where such content is illegal then I'd say they'd be liable.
So if google stored that video on their hard drives in Italy, they should be liable to ensure what data they store is within that country's laws. They by rights should be aware of what content is stored on their media servers; they need to be accountable for that otherwise, everyone would upload anything and everything.
ISPs on the other hand just allow access to it. They don't own the hard drives/servers that the offending data is stored on. Maybe they could be held accountable for locally cached data, but I think thats as far as it can go; It would be like finding BT guilty for allowing a 5yr old to phone a sex line.
