Question Who's responsible for weirs / streams?

Hi

This is/was a nearby weir in the stream that goes past my house,



That was this time last year, this is it now,



It's a bit fooked!

Who's likely to be responsible for it? It doesn't really bother me, other than I'd like to see it rebuilt. It's nothing to do with me and it's downstream of my house. I am a bit bothered about the tree that looks ripe for falling down though!

It's a bit sad really, I can't see anyone wanting to stump up for fixing it, no doubt it'll just get left to sort itself out. It's already washed a hell of a lot of stuff away,

As I understand it, it is the responsibility of anyone with riparian rights on the water where the weir is situated.

My angling association was offered the sole fishing rights on a stretch of water near Buckfast, but that included the maintainance of a weir on the water. We could not afford to take it on.

The Environment Agency will also have certain responsibilities as well.

It could be one of many bodies but as its affecting the stream height management, oxygenation of fisheries, flood risk then call the Env. Agency first with map reference if possible and they can advise.

Looking at it, I reckon it adjoins four different properties! One is a farmer's field and another is a block of flats, can't see them being right bothered! The other two are just private houses.

The level has only dropped along a stretch of about 50 yds and I very much doubt there are any fish in there, it's very near its source at this point.

It looks as if it might undercut, and collapse the footpath on the left of the second photo, so how about the local council.

Failing that, try your water provider, ours is Severn-Trent.

That's actually a footpath, it's a parking area for the flats... you're right though, it looks like it'll wash away soon enough! It's gonna take a right beating soon when the rains come!

If you follow the flat area down in field from the gate, is there a building like a mill on the RHS?

You need to inform the AE at the very least.

They are responsible for wiers/rivers, plus if it ends up as the landownders responsibility to replace it, then the AE will want to monitor it's construction and height.

(You cannot even p#ss in a river without filling out a form these days...)

They'll now have to do a full risk assessment to decide if anyone can look at it, that water, it's dangerous

Is that the remains of a water run off gate as well? - probably the reason why the weir failed - as in the gate wasn't opened.

Dunno Gene, don't think the stream could have ever got that high tbh, more likely to be summat coming the other way but I don't know what... I don't think it's seen any action in a while! (**** off before you say it! )

I think you are right DCI, it certainly looks like the entrance to a leat, which might even be the reason for the weir being there anyway. The owner of the leat may not need the water anymore. Maybe it ran a water mill.

Just had a phonecall from a man at the council, they can't do anything! Unless the watercourse is blocked and / or there is a risk of flooding they don't have any powers. They can't even do anything about the tree that's about to do fall down... however if when it does fall it creates a risk of flood...
