We have a telephone system that is under a yearly maintenance contract. We have fallen out with the supplier and one thing that we are nto prepared to pay is the annual maintenance agreement.
I have asked in the past can this be cancelled and I was told yes it can, no problem.
We receive the invoice today for the period 02/05/10 to 02/05/10 - it is dated 5th May and we receive it on the 10th. I called to say I want to cancel the maintenance and to complain that the invoice is dated after the period of the contract which I felt wasn't right.
I was also told that we have to give a minimum of 42 days notice before the contract is due for renewal. Now I have to admit that the agreement does state the 42 days but my beef is with the receiving of contract after the renewal date. To me its smacks of sneak tactics in order to get stuck into another year.
We have a very poor relationship with the supplier so having to pay them a penny irritates the hell out of me.

We supply and maintain phone systems and that does sound wrong to me.
Our contracts are initially 1 year then automatically turn to a rolling 90 day contract.
You will have to read the T&C's on the original contract that was signed.
Alot of the times you are not actually in contract and they prey on the "weak" as you would be surprised how many people just pay!!!!

As above. Just refuse to pay. The worst that can happen is it goes to small claims (assuming its a fairly small sum). Any of the distance selling regs on your side? What actual work have they done in this years contract? I dont think they would have much chance TBH.
