Just had an accident myself - a little advice
Ok just been teaching at a local gym who will remain nameless - i teach swimming just starting out, new career and all that. Ironically my first day there (and my assesment) - and possibly my last!
walking along the poolside my foot went straight through the plastic grate that runs down the pool.
Outcome is a sprained ankle and torn ligaments (according to A&E) cuts to my leg and a cut hand and now one of my wrists has also swollen up. It could have been a lot worse looking at the sharp edges down the hole.
i looked at the supporting ledge it sits on and it was loose/coming away. One of the lifeguards i was chatting to whilst hoping around try not to swear informed me that somone else did exactly the same thing, same spot only the other day and maintenance where supposed to have fixed it. Well it looked very much like they had not or badly fixed it.
I am bloody annoyed and in a lot of pain.
To cap it all they just placed the grate back in position - i made manager remove it and put signs up over the hole as it is a real hazzard - as i found out.
This will lay me up for at least a week.
I am not big on the compensation culture but this was no way my fault, no warinng sign up, not marked/condoned off.
Question, Should i look to sue them for my injuries, i do feel really aggrieved and cannot believe their lax attitude to this danger and to undertaking repairs. I do not care if i never work there and frankly with thier attitude to safety that is perhaps no bad thing as i do not want to be associated with a company who does not take safetly and dangers to the public and staff seriously.
They did not fill in an accident form, just took my name and contact details

what do you feel you would have earned in the week or so you are going to be laid up?
Surely that should be the yardstick for all compensation claims?
Sorry to hear of your woes, the accident book thing is particularly bad practice and the HASAWA74 means that accident books are compulsory.
What happens if in ten years time the ligaments go again and it can be medically attributed to this incident?
You will state that it happened at their place and they will tell you to prove it or do one.
Phone them up and state that you wish to have the affair recorded in their accident book, that will **** them up and let them know that you are aware of legislation.

I have been getting some weight off vigerously doing your sister and missus. Now i have a sports injury i suppose it will be back to the vibrators for the pair of them. Lets hope it doesn't interfere with the tv picture too much with the heavy duty, 3 phase powered models the like so much

If your not bothered what they think, take it all the way, it is an incident you could really push and probably get some compo from.
I would expect the big wigs to make your life more difficult afterwards mind.

I was a lifeguard at a public baths for a few years, never had so much ***** in my life
Then I did my ASA teachers and started on the younger mums while getting £12ph (which in 1991 was bloody good money).

Paul, get back there and fill out the accident book it is a legal document and needs to be completed and providing you are in a fit enough state to do so you should fill it in to make sure it contains the correct information
As far as claiming goes you should be compensated for your injury and the time off plus the fact you may not be able to work for them again.

They certainly don't seem to have shown much concern about the accident which was clearly down to the failings of the drain cover. That could easily cause a much worse accident, especially to a more elderly person with more brittle bones.
I think it would do no harm to put the fear of God up them Paul if only to make them take a more responsible attitude to the whole thing.
