Default legal advice

iv been of work for 2 weeks wth a bad neck the doc has given me drugs that are working and went to see my doc and he said that i could go back to work now went to my boss today to say im coming back and she said that i shouldent come back if my doc said that i can work i cant see why my boss could stop me from working

Is your boss a medical proffesional? Have you seen a company Dr or occupational health?

Amego, let us get it right. You have been to a doctor and he has said you are fit to work. You've gone back to work and your boss says you can't come back? What was her reason for not allowing you back? How long have you been there? What job do you do? Bit more info required than yes/no answers if possible

What type of contract do you have? Is it agency work? Some agency contracts guarantee 0 hours per week.

been there for 8 years i thnk her reason s that this time of year it is slow in work and she would be better of paying me sick pay rarther than my full wage im a class 1 trucker no agencey

Don't care if it's slow, go and turn up for work. You can't be paid sick if you're not on the sick. If you do everything right, then it won't come back to bite you on the ***.

A trucker? Taking painkillers? Your employer may have forecause to be worried. Could be a difficult one to call. They should refer you to occ health or equivilant company Dr if they are unsure how the drugs you are taking will effect you & your ability to perform your role safely. IMO you should be on full pay whilst your employer faffs about with this.

not pain killers some type of pills to relax the nervs in my neck pills are called gabapentin

Source Wikki "Adverse effects- Gabapentin's most common side effects in adult patients include dizziness, drowsiness, and peripheral edema (swelling of extremities);[34] these mainly occur at higher doses in the elderly."

I would have reservations putting you in a truck without a written Drs opinion taking into account the role you perform. I think they should offer you paid "light duties" (not driving), until your employer gets decent medical advice.

Thing is, if you'd have said you were on pain killers and they said you can't drive a HGV until you've stopped taking them then you'd know where you stood.

To say don't come in for a bit with no reason suggests as you said. They are quiet right now and it's cheaper to keep you on sick pay rather than full.

Whether thats legal or not I'm not sure - maybe speak to C.A.B. - although if you go down this route you don't want it turning into a bun fight with your employer.

well im going back sunday i dont think she can do anything about it
