Any Party Wall Agreement experts here?

Hi there
I'm planning to build a side extension to my house. This would take the side of my building to 1 metre from my neighbour.
The PW advisory document says I need a PW agreement if I intend to build/lay foundations within 3m of my neighbour AND if my planned foundations will be deeper than my neighbour.
My plans show a foundation depth of minimum 1m. Now firstly how would I know what my neighbours foundation depth is? Secondly even if I knew it was the same/less than mine what if the Building Regs inspector asks for my foundations to be made deeper when he comes on site and sees soil conditions etc?
So I can't really figure out whether I need a PWA or not.
I get on very well with my neighbour and have kept him informed of my plans by sending him copies etc and want to keep a good relationship. However if I don't need to enter into a PWA with him I don't want to as it will afford him the right to appoint a surveyor (at my expense) to inspect the foundations etc.
Any advice would be appreciated.
