Surely this is the get-out clause for most people though
And perhaps most crucially the letters cannot hold the bill payer liable if someone else used their internet connection to download illegal material.

there's also a note about unsecure wireless connections in it as well, i can see most lawyers making that case pretty easy.
the letter is 100% scare tactic, also you need to get 3 of them to actualy be done so it says.

while i don't condone piracy i think if they dropepd the price it would make a massive difference, say a DVD was £3 or £4 we'd just pick up the film we wanted rather than download it.

It wouldn't matter what they charged. There's a generation out there now that see stealing as perfectly acceptable, just look at all the theads on here brazenly asking for sites to download films, TV and music from.

Whilst I agre we need to crack down on illegal downloading, can't see how this could ever work with the likes of BT Openzone/BT Fon when you have no idea who's using your connection if you subscribe to it.

That's the point. Everyone doing it seems to think it won't matter it's only them.
It's the same mentality that people chucking a tab end on the floor or dropping a McD's wrapper have. They fail to realise that thousands of others are saying the same thing and the culmilative effect is huge.
I'm sure a few people will be trying to hide these letters from the Mrs though, especially as they are askign all other ISPs to give them the same info.

Useful info on here for anyone that does get a letter http://en.wikipedia.org/wiki/Ben_Dov...tive_Invoicing. Sounds like a simple shakedown if, on the admission of their lawyers, they have no intention of taking anyone to court and their evidence linking IP address to subscribers is dodgy.
I wonder if they had permission from Simon Nye when they made "Ben Dover's Ben Behaving Badly", or Ian Fleming's estate for "Ben Dover: For Your **** Only" - or would they argue ripping off someone else's material like that is fair use.
