Item not received from china.

Hi, my dad bought an item from a collectors forum, based in the uk he paid £450 for it, the seller was up front and said he was from china, seemed genuine.
He's sent the item, and as its arrived in the uk, customs have seized it, they state the item is a counterfeit. It was sold as genuine, and everything looked right.
He paid through paypal not as a gift, but for goods. He also paid using his credit card, can he claim the money back using paypal or the card company? The seller at the minute is being ok and he says is chasing the item with uk customs, but clearly that won't get anywhere.
If he refuses a full refund, will dad win a claim from paypal as he has not received the item?

PayPal should get your money back mate if it's counterfeit and not received, escalate into a claim, or credit card if PayPal are not playing ball, it's counterfeit and you don't want to pay for it so you are not agreeing on payment. On credit card you can get money back as its borrowed money,the banks and not yours, debit cards you cannot get money back.

I rang, they say its a counterfeit watch, and they don't allow them into the uk.
Dad seems to think the credit card company won't allow a charge back as he used it through paypal? Any idea if that's correct? Also will the seller have actually got the money in his hands yet, or will it be when the package has arrived?

I have barclaycard as my paypal method and if I have a problem I tell barclaycard first. They refund the cash into my account and I never have to bother with paypal ![Big Grin](https://www.scoobynet.com/images/smilies/biggrin.gif)
I actually lost a claim with paypal on my first and only attempt when a seller never sent out an item but still charged me, but I wasn't bothered as Barclaycard just refunded me so **** paypal

You have 45 days from payment to open a dispute. Leave it until about 40 days and then send a message explaining that you will have to open a dispute within a couple of day to protect yourself.
PayPal then give you so many days to resolve the issue with the vendor without getting involved (20, I think). If they havent refunded you within this time then escalte the dispute to a claim.
If you paid by credit card or Visa debit card then you can also recover the money this way. Visa is less straight forward and sometimes the bank try to be obstructive, but the provision is there.
