employer not accepted notice

Default employer not accepted notice

I have been in my current job less than two years and they are going through redundancy's for second time since I have been there (there was redundancies last august aswell ) .
The new structure doesn't suit me so I am leaving as lots of other **** going on there too and I have had enough so I given one weeks notice as required.
Now they not accepting it not sure what I am supposed to do now as they want me to go have a meeting. My worst fear is they try make me work there when I don't want to.

I don't know what to do.
Are they trying to hold onto me until all redundancy's have been sorted just to cover there own backs so they are not short staffed?.

Unless you are in breach of contract they can't refuse to accept your notice. I'd read your contract to make sure what your terms are.

Perhaps they have other plans for you - like teaching you correct grammar and spelling.

That aside, at least you still have a job - unlike the poor buggers being made redundant.

If your leaving of your own accord then your period of notice will be stated in your contract. If you are expecting redundancy then it is up to them who and when they let go.

zip very hard to type on phone as sceen keeps zipping accros .

contract states one week notice . supose just got to wait see whats in the meeting now.
just thought someone might be able to help.

If you notice period is one week and is stated so in your contract just give them 1 weeks notice in writing and then work for said week then leave.

They cant refuse your notice or make you work longer.

we are all being made redundent in some form as our jobs no longer exist we have only been given option of ****ty hours and 20 hour jobs not full time . so I have left before all the trouble starts. now they not accepting my notice.

hiya chip
unfortunatly there isnt any as I have not worked there for long enough . I looked into this and you need to be there over two years :-( so no reason for me to stay till the end infact by staying I will be causing more trouble for what I want to do next.

as long as they dont expect me to work after my notice seen as they not accepted it then thats fine I hope .

Maybe they didn't understand your letter? Try sending it again, but this time use spell check and pop some grammar in it. You might see you boss go "Ahhhh, I see" and accept.

Dont sweat it.

You have given your notice, on the last day, clear your desk / area and at

your allotted shift end, send a polite email staing that you wont be in on monday, due to you cessitation of employment.

Hand any keys, phones, passes back to security / reception as you leave.

Thats it.

Start your new job on the Monday,

Inform them that your last employer was being blinkered, and they will have to obtain P45 etc

This is a real no-brainer. As Tubby has said as long as you abide by your contract terms you are free to leave as you wish.
There must be some kind of misunderstanding as no employer of any worth would consider refusing your notice. What are they going to do? Chain you to a desk?

Just work you contracted notice and leave, you need to check your contract about leaving to work for rival companies in the same area within a specified time but they are difficult to enforce..

And don't forget to collect any holiday allowances
ps The only area I can see that might be a problem is if they try to "dismiss" you.
I'd just keep a hard copy of your notice etc. and duplicate it by email so as to have a paper trail of your giving notice.

Don't let them treat you like their slave, Lisa. If the notice is one week as per your contract, tell them that you ARE leaving, and that's that.

Some employers have Hitler style tendencies. Working for someone is a two-way thing. They pay you for the work you do. They don't own you, and you don't owe them any other thing than your quality work you do for them. You don't have to stick around if the place is unbearable to you, and if you don't want to. Work your notice, and walk out of the door. If they try to act like your owners, take them to the cleaners.

Doesn't sound like they will be around long enough to do anything about it.

It's a free country and you can leave when you want. They can not refuse your notice, in fact they can not even force you to work a notice period. If you are contracted to work a notice period but don't want to they maybe able to put a financial penalty on your last wage cheque.
The only time this may change is if you are in the armed forces ect but other than that you can walk when you want. Wouldn't you be better off waiting to see if you are being made redundant before leaving? You could get a pay off if your on the redundancy list where as you would loose this if you left of your own accord.

Generally speaking, if you're paid weekly you normally only have to give one weeks notice. If you're paid monthly you normally give a months notice. Your not legally bound to abide by this but as i said you may loose money if you don't.

Yeah, not sure I see the problem here .. go to the meeting though, they might be begging you to stay rather than "forcing" you. You never know, if they don't require anything written they might value you

If I were you, I'd volunteer for redundancy first. Then if you're not considered, hand in your notice and leave.
I was in a similar situation a few years ago. I knew about the impending redundancies and contacted the HR department to volunteer myself for redundancy, which was accepted. The benefit to this was; I walked away with a nice healthy bank balance, and someone else who needs his job got to stay.

In my old company
When we Recieved a letter of notice
We used to frog march them off the premises within an hour
Mentality of the owner
They might steal an ornament or something stupid or not try to sell something
They were the good old days
I once got a call at 910 am to be at Leeds in 2 hours to cover a shop and take a toothbrush and shaver and find myself a cheap hotel incase I was there a few days
Never mind I got a great redundancy when I left

it may be that they were going to make you redundant and by handing in your notice you are going to lose redundancy money. the meeting may be to tell you your on the redundancy list.
id go to the meeting, they may be trying to help you.
