thats bad luck mate

Chrisgr31 18 December 2004 10:58 PM

If the offence was on private land won't they have to take out a prosecution against you?

Won't that cost more than £50? Therefore will they bother?

You got all that from one still photograph? For a man of your advancing years, you have a real good imagination. ;):p

flippin heck...some of you like your own voice!

I never said i was outraged...i said "seems a bit harsh".....in fact, im hardly bothered at all.

It was my dads car, not mine....so screw him!

Just thought i'd post it on here on his behalf in case there was a way out of it....he is more "old school" than me and prob has a lot in common with the views on here....from too much gov control to pop idol being crap TV.

I see no irony other than that he has never speeded in his life yet gets hit for £50 for stopping..........i like speed cameras yet when i get caught i managed to get off the hook!

Stick that i your irony pipe and smoke it with my dad!

You could do 2000 MPH on your own property, but you could still be procecuted for dangerous driving if the police felt like it under legislation brought in to take private land use into road traffic law. Any sanctioned race or rally is not subject to this new law following an agreement with the MSA, but a normal person using his own land can lose his/her licence for hooning about on it.

andyr 19 December 2004 12:11 PM

Remember the TV prog showing this : doubt the fine would stand up to court - the sign would need to be visible to the driver just as the speed limit signs are (ie big signs with no wording, just a recognisable symbol and/or number)
I'd write them a letter telling them to bugger off and if they want to take it further then they can see you in court.

This is true, the RTA applies to any area to which the public have access. The definition of access is clearly the tricky bit here but to escape conviction you would have to prove that you had taken all the steps necessary to exclude "the public." I would imagine you would need big fences, locked gates etc. to make that work in court.

The reason I highlight this is that with winter and snow coming up it is important for everyone to be aware that you can't just nip into Tescos carpark for some safe fun in the snow. Potentially a passing police officer could slap a range of charges on you even though you were on private land and were doing no one any harm. One to watch out for.

However, to save you having to go out there in the cold to get fun you can just follow this thread and watch Tiggs squirm. Definite insecurity problems showing though there Tiggs so some councelling might not go amiss, are you sure it's safe for your dad to let you drive his car?

Well I just wrote them a long letter explaining the reasons why I felt the ticket was unjust, along with photos of the scene I took at the time, and they wrote back saying that "my appeal had been carefully considered" (yeah right!) and that it had been cancelled, so result :thumb:

To be fair to Chichester plod, they were actually really helpful when I phoned up and asked what the offence code on the ticket meant, and also how to contest it.

The 5th Gear thing said basically ignore it. It would cost them more to recover the "fine" through the courts hence they don't bother. But you (actually, your dad) will get some strongly worded letters. Ignore, throw in bin.

A photograph... Ah so that means you were driving close to the curb... ;-)

He actualy said he thought a case would not standup in court as you had not entered into a contract and that it would not be possible to read and enter this contract whilst driving into the area!
Contest it!

IIRC from a post on here, isn't it only a court of law who can impose a fine

hedgehog 04 February 2005 01:25 PM

That was probably my post and while legal advice has indicated that the Bill of Rights states this and while a precedent was set in another case where it was decreed that the Bill of Rights must be explicity repealed in any Act which gives the power to impose fines to an authority other than a court there hasn't actually been a test case relating to parking. In saying that several organisations are trying to get such a test case to court. Now, the reason there hasn't been a test case is that every council that attempts have been made to get to go to court on the matter have, after a series of nasty letters, caved in and withdrawn their case.

So while I, and others with authority and experience on legal matters, believe that only a court can impose a parking fine this is a complex area and the situation is certainly not with simple precedent.

I am also not sure of the exact situation where tiggs was sitting on his daddy's knee working the steering wheel while his daddy worked the pedals while parking. Clearly this would be a new problem for the courts in that it could be asserted that two people were driving the vehicle. I am also not sure what the significance of tiggs being a minor and clearly having psychological problems requiring counselling will be.

Report it to watchdog. Its sounds like a scam that will catch many people out and unfortunatley most will pay up.
