Default To The Person Who Has Just Bought: PK05 FZM

Scum.

I travelled 4 hours to view this car, shook hands with seller, left a deposit, arranged insurance, arranged loan, arranged train.

Only now to get a text from the seller telling me someone has purposely offered more to gazump me and take the car.

Seller and buyer, both absolute scum. I hope it burns.

I hope you get your deposit back.

Personally until I have ALL of the money in my hand nothing is ever sold, been messed around too many times. (Im not saying you were going to mess him around)

iv had two buyers pull out after leaving a deposit

1 just lied about needing his cash to help his mum
and the other couldn't sort the cash in time
both deposits (£100) was kept

but I'd never do as this man as , if I sorted a price and taken a deposit , the car comes off sale and if I got any calls regarding it I'd say it's sold pending full payment on the date arranged , and if falls through I'll let them no

I'd rather have a nice easy sale , than a **** ball for few more quid

hope you get you cash back ASAP
I'd ask for PayPal or bank trans to be honest

This is why I never leave a deposit, I turn up with cash check the car over HPI it haggle the price & leave with the car. It's a s##t thing to do to someone & I feel for you, but most sellers won't turn extra cash down.

correct me if I am wrong but does a deposit not mean a deal is negotiated? why would he then take another offer, other buyer is not in the wrong here by the way, he probably didnt even know it was already sold.

Once a deposit has been left and accepted then a contract is in place, whether it be verbal or written.

Okay in the real world the seller can just refund your money as there is nothing to be gained by taking any possible legal action, but I agree that once a deposit is left the deal is all but completed.

I dare say if you pulled out the seller would happily keep your deposit, so he must also accept that he has to hold up his end of the contract.

Its hard enough trying to find a good widetrack without things like this happening. Almost ready to call it a day and look for something else.

Its ok if theres any business as 1) I was sensible enough to ask for a hand written receipt and 2) I know where he lives

I'll ring the police if need be or in keyboard warrior mode, go down myself and rip him in three.

Police wont do anything as it is a civil matter and a hand written receipt isnt worth much either.

A cheque screams dodgy to me, he shouldnt have any issue doing a bnk xfer instead if he is writing a cheque it all comes from the same place!

Why did you go and view the car and leave a deposit too before even getting a loan? What happens if you got refused for the loan??? Surely it would be better to have the loan first so you've got the cash in your hand to buy a car

Its the way Ive always done it, why get a loan first as depending on the car you see, you may gave too much or worse, too little.

The irony is I had the cash available to lend from a relative if only I knew this would happen I could have collected today. Lesson learned though, I can see your point.

Same here, I've never looked at a car without the cash on me.

I used to hate it when someone would come and look at a car I was selling, keep me in for half the weekend waiting then leave a deposit saying they'd collect next week. *If* Intook a deposit, I would honour the buyer though. But I'd rather not do it.

But then when I'm looking and have the money, if the right car comes along I want it yesterday, don't know how people can go look with no intention of buying there and then especially on a rare car.

I can see where he's coming from as I've had so many messers, people wanting to leave deposits when they 'have to get a loan' and stuff like that. But what he should have done is said he wouldn't accept your deposit but you'd be welcome to buy it when you have the funds. I know a lot of people have no problem with taking deposits and waiting a week or so but you're leaving yourself open to the risk someone else will ring up. It's human nature when something rare and or desirable is 'sold' interest picks up, see it in forums all the time. A cheap car will go for sale and 5 people will ask for pictures rather than getting their **** in gear and buying it then the seller will say 'sold' and there'll be a load of fuss from these lazy buyers.

You'll probably find someone rang up and the seller said he's left a deposit and hopefully collecting in a week. Then that stirs the guy up making him want it more hence offering the seller more cash.

Main thing bugging me is I text him lastnight saying all particulars were in place and even confirmed what time the train would arrive.

Are you sure he's sold it someone else or at the last min when he realised it was actually going to be "sold" decided to keep it.

As others have said hope you get your deposit back and another comes along. Took me months to find my widetrack STi and same as you after a few failed attempts I did eventually find a good one. Had to travel 300 miles to get it but was well worth the trip

I made a point of asking if it was still there as would have counter-offered, but it had gone.

Dont mind jumping on a train to get the right car. When I sold my old 2005 STI a chap paid me without seeing it and travelled from the top of Scotland - now thats comittment lol
