Insurance & excess

Question

My father was 'rear-ended' yesterday and damage done. He's contacted the insurance claims dept and reported the accident. However, reading his policy, it appears he has to pay the excess and the insurance company wont attempt to recover this. Even though its the other party who is clearly to blame, ignoring the fact its a rear-end crash there are 2 witnesses who 'blame' the other party.

Why does he have to pay the excess (he's the victim) and why wont he get any help recovering it? What is he supposed to do? Why do victims always suffer?

Any help, much appreciated. Thanks.

In any claim whether its you fault or not you will have to pay the excess!!!

Don't know why they wont try to get it back for you though

Your dad can get his excess back quite simply - ask the other driver for it .. he or his insurance will pay it (your dad then retains his NCD) and it will only count as a 'No-Fault' claim.

The small claims court is there to use to get your excess but its highly unlikely that you will need that kind of 'persuasion'
