Just got done on the A4 (LASER)!!!!

Unhappy Just got done on the A4 (LASER)!!!!

I was driving up the A4 near Hounslow to drop my girlfriend off, and hiden was a police car with Laser Guns!!

They pulled me and the car next to me over, and told me that i was doing 63mph and the other guy i was told was doing 59mph...this is in a 40mph zone...

Anyway, i could swear also my girlfriend that i was no way doing more then 60mph...so...the guy they claimed was doing 59mph was let off with a warning and i was given a ticket & a Producer!
They said, we have certain speed limits we can let off!!!!

Why: personally i think they lied about the reading's and confused mine with his...ofcourse my car was a Subaru that looked like a spaceship and he was in a Escort i think..and had kids in the car!

Most annoying thing was that he was let off, and i got a ticket!

Any thoughts on what i should be doing when i recieve the letter through the post? i want to contest this as i think i was treated very unfairley..

63mph in a 40, surprised you aren't in line for a day in court to be honest. And they let the guy doing 59mph off completely? Sounds bizzare to me. Both speeds are well outside the 10% + 2 rule.

good luck, but if you were over the speed limit, I'd accept the fine, no point trying to contest it.

Sorry to hear the bad news ,i was done 2 weeks back by a mobile van.
Also looking into contesting, try reading through the replies i got in this thread

The 10% + 2mph rule is not a written rule. They can book you for being 1mph over the speed limit.

Sam,

At the end of the day you were caught speeding and there is not much that you can say about that, if you dont want to get caught there is only one sure fire way, dont speed.

You may be very lucky and get offered a fixed penalty, as you are just a couple of MPH under the guidelines (and that is all they are) for a court summons.

very true, but I'd expect them to use some discretion if they are pulling you over at the time, both speeds quoted are well outside any 'leniant' rule bending.

Found this:

That is Radar, you said you got done with a Laser, which can get a speed reading in 0.3 seconds.

that i was no way doing more then 60mph
that's in a 40 limit, so you haven't really got cause for complaint for getting a 3 pointer, IMHO. OK, perhaps the other guy was going at pretty much the same speed (63 and 59 aren't that much different, lets be honest) He got let off and you didn't, which isn't entirely fair, but going at 50% over the limit you have to accept that there is a risk you'll get nicked.

I'm not trying to be moralistic, whilst I tend to stick to 30s, 40s and 50s, I do speed on occassions. However, if I do 80 in a 60 limit or 90 on a motorway, I accept there is a risk I'll get caught

63 in a 40 is unlikely to result in court appearance - in some counties at least they have a "fixed penalty until 25 over the limit, then at officer's discretion" policy

I got cought in my Smart Car near 5 years ago..doing 61 in a 30 (DUAL carriageway in uxbridge)

Banned me for 2 months, and fined me £450! even after providing a letter from work that i was going to loose my job if i can't drive..

3 points on the licence means the scooby needs to go... East London aint the best for insurance...

So will fight this one i think...

but the Law states one gun can only be used for one car at a time..they can not pull 2 cars over and provide two different readings to the driver's at the same time

11, MULTIPLE VEHICLES

11.1 Radar speed meters are designed to measure the speed of one vehicle at a time. Should there be more than one vehicle present in the radar field of view it is possible for the device to detect two different signals and alternately display different speeds as described in 9.2(e), in which case the check MUST be aborted.

11.2 With vehicles of similar size within the range of the radar, the meter may read the nearer vehicle, but not necessarily, since the reflected signal from a vehicle is very complex and fluctuates rapidly as the view of the vehicle changes slightly. AN OPERATOR MUST NOT MEASURE AND MAKE DETECTIONS FOR PROSECUTION WHEN MORE THAN ONE VEHICLE IS WITHIN THE RADAR DETECTION RANGE.

11.3 It is quite possible for the signal from a large vehicle some distance behind a smaller vehicle to override the signal from the nearer vehicle.

I haven't read all the reply's on here. At the end of the day you were speeding so you can't argue with that. As you were less than 25mph over the posted limit you are eligible for the fixed penalty system, fair enough.

Hypothetically if this is what happened

I honestly don't think you would get off any ticket in this situation however you have good cause to complain about the Officers who dealt with you. Also if you opted to go to Court then the officers would look very stupid when cross examined by a defence brief.

It is un-professional of the Officers to tell you the speed that the other vehicle was travelling at. It is very unprofessional to then let them off for a 19mph indiscretion and ticket you for a 23mph breach. Both of you were more than worthy of a ticket. You could easily make an allegation of "how do I know it wasn't a mate of yours?"

To the best of my knowledge an Officer should never reveal the speed a person was travelling at unless they are going to deal with it by way of ticket/summons. I would be very unimpressed if I were in your position.

I don't doubt you recollection of the events however there are always three sides to every story. Yours, theirs and then what really happened.

RADAR and LIDAR (Laser) work using different technologies.

As I said it takes as little as 0.3 seconds to get a lock and speed reading on the laser gun, and there is no legal requirement to show the speed reading to the person stopped.

If it was Radar (older and not really used anymore) then if you were alongside another vehicle you could prove the reading unsafe. The CPS would then just run a case against you that you were over the 40mph and not argue the exact speed. You would still get minimum three points and a fine.

If it was Laser your stuffed. There could be ten cars driving in a line and anyone could be picked off if they had line of sight.

You have been banned once and you haven't learnt the lesson? There is such a high chance of getting caught speeding these days that ones driving habits have got to change if you value your licence.

That's not me preaching, its just a fact of everyday driving life as we now know it. My suggestion is you tackle the root cause of your problems now before its too late.

Sam, whilst I hope you can get something from Craig's info, two things:

1) Check with your insurers. Not certain, but some don't really care much about a single fixed penalty 3 pointer, as so many people get them these days (1 in 3 drivers?)

2) I recommend you think about "risk management". I'm not judging whether it was safe to be doing those speeds as I don't know the road in question. However, if you can't afford to get 3 points, regularly driving 20mph+ over 30 or 40 limits where you know you might get caught is not worth the risk, IMHO. I sometimes travel at "3 point speed" (when I believe it safe etc), as I can live with the consequences if I get caught. However, I avoid "going to court" type speeds, as I don't want to live with getting a ban. In the past when I had some points on my license, I drove slower as the consequences of getting caught might be worse.

Sam, I guessed this would be your reaction. The point I am making is that while we all make mistakes by your own admission you have a record for speeding. If you are not more careful you will keep getting caught out. Its your choice mate

Oh by the way, if I was your mother I would have put you over my knee by now and slapped some sense into you

I wont be putting up a post for speeding if it ever happens. I'm not that daft. I would simply hold my hands up and take my punishment

Sounds to me like both of them have got a valid point!

Let me see... You've had one ban already. You were way over the limit this time and the copper saw you before you saw him or before you could slow down. Sounds a fair cop to me!

Slow down, mate. Save the fun stuff for the open road where there's no-one around to maim or kill other than yourself!

It was the A4, the roads were pretty much empty! Though still i still wouldnt consider driving at 60 as being fun...

At the end of the day the A4 in that area is a 40MPH stretch of road, so anything over 40MPH and you do run the risk of getting caught.

Agree with this totally..

you were speeding.. think yourself lucky it was only 3points!

I speed, I admit it but if I got caught at 59 or 63 in a 40 I would take the 3points pretty damn quick.. at least it was real Police officers and not some flipping camera.

Take some responsibility for your own actions man! yep no one likes it and if it were unfair then contest it.. but you were caught fair and square.. if you want to get let off speeding then buy an Escort and have some kids..

I do know the road in question and the limit is a bit daft in my opinion, the road is two and 3 lanes wide on each carriageway so if there was no houses it would be national speed limit but you can't cross the road anyway because of a guard rail down the middle and the amount of traffic. I'd personally say that 50-60mph down there isn't dangerous at all.
