55 day N.I.P.
i have had a nip arrive today 55 days after the camera caught me.i understand they have to inform me within 14 days so i have written a polite letter saying this.the only thing is that the car was still registered at my previous address .i changed the address last week and this maybe why this has just happened or maybe coincidence.i have been to my old house and the new owner insists there has been no post.(i had mail divert but i think it had just run out when the alleged incident happened.)
i was doing 98 in a 70 limit so if they can still do me, dose anyone know what points/fine ill get.

was the NIP issued to the last address within 14 days? it will be dated mate, if so, i think it will still stand. They wont accept blame for you changing address

if it was sent there and it was not returned marked "no longer at this address"wouldnt they have continued to prosicute?

im not sure on that one mate, but from what i know, the NIP is within the guidlines stated.

NIP has to be sent to registered keeper within 14 days. If car is not registered or change of address etc. then tough. It has been delivered to you before the 6 month for prosecution deadline so you must either pay or elect a court hearing. 98 is likely to be a court appearance I'm afraid.3 points and a fine...

And to prove service all they have to do is tell the court that they put a first class stamp on it and posted it on such and such date. They don't have to undergo the same standard of proof that Joe Public would have to if they wanted to prove they had posted something.
Apart from that the 14 day rule is there because it's unreasonable to contact someone more than a fortnight after a road offence for which they were not stopped at the time, and expect them to remember having committed it. Unfortunately, you've come on a public forum and admitted to doing 98 in a 70, unless that was a slip of the tongue and really you meant that it has been ALLEGED that you were doing 98 in a 70. There is a big difference.
