ADVICE! 3pts & £60 fine for "contraviening a double solid white line"!!

Default ADVICE! 3pts & £60 fine for "contraviening a double solid white line"!!

After some help / advice from some people in the know please!

Was on the way to drop a mate off late last night (11:45) and was going through an S bend which was double white solid lines, and (as most ppl at night) i took the "racing line" through the bend. Got to the other side and there was a police focus sat in the gateway the other side.

Obviously he came after me and pulled me over a few hundred yards down the road. I got out and met him on the kerb. He asked "do you know why i pulled you over?" my initial reply was that i might have been going a bit quick up the hill, to which he replied " no, it was for crossing the white line"

I though for a second and then replied, yes i might have been just over it, but corners are some of the best fun you have have legally in a scoob on the road. He then challenged me to say the car was completely across the other side of the road to which i am 110% certain i was not!

Realising i wasnt gunna get anywhere i shut up and let him write me a ticket. £60 fine and 3 points, license to be surrendered within 7 days and fine to be paid within 28 days. I also have 28 days to contest.

What i want to know from you guys is what do you think my chances are if i contested it.

I can prove that the car can get around that s bend safely at 60mph, he was also on his own and i had 2 mates with me as witnesses. It was also pitch black late at night! Or does anyone know any loop holes in this law.

I am thinking of when i produce my documents, asking if i can see video evidence of the crime, and if he hasnt got it then its his word against mine with two witnesses??

What do you all think????

Seems like a tough break to me. I always thought you could only get pulled over if there was 2+. Or is that an old wives tale?

Might be easier to swallow it but ****' it sometimes you have to stand up and fight. do your homework take your digital camera and record time - take pictures - contest that their is no way he coudl have seen you cross the white lines.

My old fella got done a few months back - copper was a right a*** with him and to be honest i thought he wouldn't stand a chance - anyway got as much evidence as he could and turned up to court. the prosecution decided 30 minutes before the hearing that they were dropping the charges - result!

how many coppers was there if there was only one and they didnt have a cammera or radar then contest it as they have to prove it

alsofor them tolegally charge u there must be to pigs there but fight it mate they have got away wi things for to long in edinburgh we used to all sit and have a goodlaugh now it dont matter where we gothey always move us andalways come up wi some stupid to muck us about

yea if there's only one copper i'm sure they can't do nothing.
and my mate was doing an advanced driving course with the police and they told him its fine to use the whole road on corners when safe.

I've always thought that too when it came to 'normal' police, as for traffic police I've been led to believe that it is only one that is needed.

As you said though, could be an old wives tale.

yea ur right there mate ive got ma advanced drivers and aslong as ur not drivin like a nutter and u are in total controll off the car then it aint an offence

if theres only onecopper they can only give a warning as they need another for evidence etc

I want to fight it but not sure. Only i already got 6 points on my license and only got my scoob last thursday!!

Yeah there was only one of them, and i was sat in the fornt of the pig car and there was no tv screen or video equipment in the car.

So if i ask for evidance when i present my docs they are obliged to provide it before charging me?

yea they must show u the evidence and if they say they have video etc ask for the pace guide line sheet and that will f-ck them up trust me mate i used to work in the traffic dept ment wi the court fight it they have gotto prove ur guilty

But it is an offence if you crossed double white lines (or a single solid white on your side of the road) to do it, even if there's nothing coming the other way. Only allowable reason you can cross a solid white line on your side is to pass a parked or very slow moving vehicle (e.g. pushbike or tractor. An old Granny doing 30 mph would not be a reason!).

Solid white lines are there to prevent you crossing on to the other side of the road as there will normally be a blind/partially blind corner or summit involved. They're a "must not cross" rather than a "should not cross".

Now as to whether one policeman can do you if they're alone is another matter.

so what !! if you can prove you car can do bends safely @ 60mph... does this mean people with ENZO can go on the motoway and do 130mph and say "dear officer, i can prove my car can cruise safely on the motorway @ 130mph and its legal" ???

i am sorry but form what i read, you are driving like an idiot, there are plenty of empty Back Roads or country roads in the UK which you can do what ever you like whch doesnt effect other... doing this on pulbic roads are danger, what if someone suddently cross the road??

but thats the point there must be too policemen to back each other so no one is tellin lies get what i mean or the copper on his own could say u were doin anything

Sorry but if you;d have crossed the white lines and hit something coming the other way it would have been your fault. You are therefore at fault in this instance and should pay up ..... To say its some of the best fun you could have in your car is pretty iresponsible IMHO...

Whats the pace guide line sheet?? And if i ask for video evidance, am i entitled to have a copy to take away if they do have it. Please, sorry for going on but i need as much ammo as possible, im fed up of been fcuked by the *****!! (No offecne to the nice copper, as i know there are 1 or 2 lurking about in some places!)

If you are man enough to do the crime(and putting a wheel over a double white line is an offence) then you should be man enough to do the time! (or take 3 points and a £60 fine), A freind of mine was banned for a month for crossing a doulbe white line on his bike a couple of years ago so it could have been worse!

yea u will get a copy if they have the evidence and why shouldnt we fight ok some off us do stupid things in our cars but every one does and the police are makin money out off us toget their new cars no one says anything when the cops break the law when there on duty like puttin the siren on and blue and two just cos they is late for there tea break eh

Im not condoning what i can do and im not saying that if the car is capable of doing something then its safe (Or id have a ******* F1 car on the road!!!) what i meant by that comment was that the bend is not that sharp therefore there was no need to cross the line!

All of you slagging me off here, can you honestly say that you have NEVER broke the law whilest driving your car??? I seriously doubt it!

EErrrrrr that comment wont help things, bottom line is that you broke the highway code and hence the Road Traffic Act, you did it, you should pay up or if you feel lucky try and lie your way out of it (if you can) BUT, if you get caught spinning a tall tale don't come moaning back to SN when you've been banned for 3 months .

Yes i have broken the law while driving, and i have 6 points on my license to prove it, what i did was hold my head up high and say" OK YOU GOT ME BANG TO RIGHTS" and i never once complained about it to anyone, let alone broadcast it to the nation!
In 20 years of driving i've only had 3 convictions, so i think i'm quite lucky!, If you break the law you have to be prepared to take it on the chin.

Not true where solid white lines are concerned i am afraid. The offence is committed the instant you cross the solid line, what is on the other side of the road, or whether it is clear or not carries no weight at all.
Cross the line, committed the offence, simple as that it really is.

I understand that i broke the road traffic act, please dont carry on about it!

Ok ive worded some comments wrongly in this thread, but what i want to know is can i fight it if there is no witness or evidance to back up the coppers alligations!

Anyway even the copper himself said if i had clipped the line or if only two wheels were over it he would have let me off, and i know for a fact the full car was not completly ovver the lines, it would be a suprise to me if there was much more than the two wheels over tbf!

Don't dig yourself into a hole on here, The courts will take the coppers word unless you can afford a top notch breif, then it's still a slim chance you would get off!,It's your call, you contest it and you could end up paying much more, as well as as a ban or 10-11 points for your trouble, you have some advice think about it!
