Default Speed Camera Question

Can you get caught by a stationary Gatso speed camera if your on the wrong side of the road?

I was coming up the A1 yesterday and was stuck behind a bunch of caravans, so when the road was clear i pulled out and overtook them. There was no speed camera on the side of the road that i was supposed to be on but there was one for traffic going the other way. As i went by it i was flashed twice. Can anyone shed any light on what the law says on this?

The laws have change slightly recently.. They used to be required to submit two forms of evidence, the radar reading of your speed and the lines on the road could also be used to calculate your speed if you wished to contest the evidence and take it to court...

But with the advent of the random placement of modern laser mobile cameras this was kind of "massaged" out..

So what your saying is that i could still get prosecuted?

I was under the impression that by law stationary cameras had to be clearly visible and marked with the yellow and red stripes. The camera was on the other side of the road so has no markings on the front at all.

Has anyone else on here been prosecuted this way?

Yep..

Check out Pepipoo, loads of people have been done recently in similar circumstances.. You could also get done for dangerous driving if you contest it!

I've had a quick look on Pepipoo and from what i gather anyone asking about being prosecuted when face on to the camera get told that if it flashes when face on there is no film in it, quote below:

"if a gatso flashes you when you are going towards it then you are likley to be speeding and the camera isnt live. they only take pictures of you going away when its live. theres a switch inside thats is for taking pictures of any speeders (when not loaded with a film) and away from (when loaded with film)"

I'll have another look though to see if i can find anything about the people who have been done recently.

Stationary roadside Gatso cameras still flash from either direction whether they are loaded or not..
You wont' be done for speeding in the circumstances you described..

I have been flashed loads of times, if it was just once there is no camera in the Gatso, just the flash unit to deter peeps from speeding, twice is a different matter

usually if the flash is there the camera is also, was it definitely a Gatso ? there are a load of Truvelo on the A1 and they take front facing pics ? they are in the middle of the road usually though so they can turn them.

It was definitely a Gatso camera as it was on the other side of the single carriageway road and only had markings on it for traffic approaching from the opposite direction. I'm pretty sure the new Truvelo are marked so that you can see them as you approach, so not one of these.

it it was a white flash, your off the hook, if it was a front lash unit (red) then you may be in trouble..

No mate it was certainly a white flash, so fingers crossed i'm in the clear. Think i'll be a bit more sensible in the future though!

i have road angel and it dosent warn me driving into those type camares
only when driving through the proper way

Surely it's acceptable to exceed the speed limit when 'performing a safe overtaking manoeuvre'?

I am sure that was in the highway code.

You'll be OK.

A mate of mine (!) regularly baits the cameras on the wrong side of the A40 between Gloucester and Ross by speeding towards them. They often flash but usually the second flash is after you've past. If you saw two flashes then you weren't going fast enough......

Don't worry about it at all.

As far as I know GATSO's cant get you as you describe, only driving away...

I have had them flash me a fair few times in the pas the way you describe

Unfortunately thats complete b***** I earned 3 points froma scamera van for overtaking they dont care if you slow down after. There is no such thing as a safe overtaking maneouvre if you have to exceed the speed limit to do so (in their eyes anyway)
