Its compulsary..... I think they'll give you a 14 day notice if the emissions are out, to get it sorted then retested. Just a matter of swapping the pipe if that is the case.
Otherwise a summons for having a technically non-roadworthy car, due to the emissions being unlawful.

Take a look at the Vehicle Inspectorate website http://www.via.gov.uk/enforcement/ro...troduction.htm and it'll explain all about roadside stops.
I once got stopped in my old XR2 and had a bald tyre and a defective rear number plate light. I had 14 days to get then sorted out and then checked by an MOT station who charge you for the priveledge and they send off the form to the police saying that everything is OK.
Originally there were going to be on-the-spot fines for cars that failed emissions tests but these got thrown out after someone went to court and argued that under certain conditions (i.e. cold car, sat idling for ages etc) the cat convertor won't keep emissions below the desired level.

Heh, when I was a student in Bradford I was driving a VW Polo (I was skint, ok? ;-) with 3 bald tyres. The coppers stopped me, gave a real bo11ocking for the state of them and gave the choice of 3 points per tyre or escorting me to the local tyre shop to buy the necessary replacements.
Needless to say.... Nice of them to give me the choice though.
