I'd say yes:
"The exhaust system

Is secure, complete, without serious leaks and silences effectively."

In theory it should fail, in reality it depends on how fussy the tester is!!

The center section has a hole in it so it was blowing a bit. So i was going to cut that back about half an inch and weld a pipe all the way out. So wasn't sure if this was and M.O.T fail?

Think it depends on the tester and the noise......I had a car fail once cos the tester was convinced the baffles had gone in the backbox because of the noise, so failed it..

If it on your Justy, then i can't see noise being the issue

You could just put your hand in your pocket and treat it to a nice s/s system

I've had a car pass the MoT without a back box - infact without any boxes, a straight through system, nice and loud! As said it depends on the tester.

Yeah go for it mate, you got nothing to lose. If it fails then you'll have to re-think but until then.............

I passed an MOT with the exhaust finishing at the centre pipe! Was still waiting for the back box in the post.

**** ME!!! i must be in the wrong job! the most i could afford at that age was a 1.1 uno! mind you, i had 115mph coming down quite a hilly part of the m23. pretty scary when you can see daylight through the top of the door frames due to flexing and the steering wheel was shuddering so much, any gal would of loved it!!!
