Default Have you ever been miss-sold a car? (forged engine turns out to be standard)

I've just come to sell my impreza and I was told by the previous owner that it had forged pistons and rods, the first buyer I had was more clued up than me and asked that I speak with APi to confirm the engine spec.

I just got off the phone with one of the lads and he says it was a standard rebuild, I just looked at the reciepts and assumed 1800.00 plus labour was for forged parts.

I'm going to try and get hold of the guy that sold it to me today/tomorrow depending on work, since he might have had the forged bits from a different garage (unlikely).

Where do I stand in a situation like this, it was originally advertised on ebay so could I contact them with the listing date and ask them to send me the description?

i would of thought it coems down to SOLD AS SEEN mate, you might be able to do something but i doubt it. i guess it was down to you to ask these questions and see proof before you bought it, possibly of called api before you won the car. ebay can be very miss leading but best oif luck

This is what i'm thinking, i'm probably ****ed... but i'm hoping someone has come out on top in a situation like this and has some advice.

the only thing i could suggest would look at the mis sale of goods act on direct.gov and good luck im sure ebay could do something especially if you payed a deposit through pay pal

What was the wording in the listing, did it actually say 'forged engine'?

Then you might have something. Follow it up with the seller, Ebay and Trading Standards if you have to.

If you don't ask you definitely don't get!

I would imagine you'll have less than no chance in getting any satisfaction from this.

Guess its a lesson to us all, unless proof can be provided that the engine internals have the parts claimed by the current owner, the assumption can only be that its a standard engine.

What harm can asking do? Go for it.

TBA though it will probably get more interest as a standard car anyway.

I'm not too bothered I guess, like you say it's good experience that I can apply to future purchases and life in general.

It is still worth a go though mate, email paypal, and ebay, speak to trading standards you might be suprosed what you hear. at the end of the day you have nothing to loose.

i dont think it falls under sold as seen as u cant see the internals of the engine and its unreasonable to assume u can.

As has been said, buyer beware. If it's outside the Playpal appeals time limit they and eBay will tell you to politely where to go as they officially don't care anymore.

Sale of Goods Act doesn't apply to private sales, and the difficulty with anything "technical" like this is that many of the people selling these cars are simply to f'ing thick to accurately describe what they're selling.

It may be that the original seller of the car made the same incorrect assumption you did Lennard - saw a receipt for £1800 and assumed this meant "forged", rather than deliberately setting out to mis-sell the car. It would in practice be next to impossible for you to prove a deliberate attempt to deceive, unless he happens to be a repeat scammer with a record.

The bottom line is that if the car has an API engine in it and has been properly cared for since, that in itself should be a positive selling point for any clued-up potential buyers, so it is still worth advertising on that basis. Beyond that, suck it up and learn from the experience.

caveat emptor P*sser though as you can't really dismantle the engine ... guess you can only check receipts etc &/or phone garage that rebuilt it at the time.

Interesting timing though as I recently agreed to buy a Scoob with a forged engine - pick it up & pay for it later this week ...

Edit - for the future, couldn't you purchase on the basis that engine is forged & state same on the Ticket Of Sale / Receipt?

I dont think any subaru engines have anything else other that forged rods, and some for sure would have forged pistons standard
forged could be stock parts, dosnt mean they are aftermarket...??

To be honest if your in the know badbird, you'll know that most of impreza's have standard rod's, even my v5 type r came with standard crank, standard rod's, the only thing that is forged is the pistons and there only semi forged.

That is why i have got a receipt from roger clark, with a sti v9 nitrated crank, sti 9 uprated rod's and acl race rear thrust and acl race big end bearing set on it as proof of my rebuild.

My post was on basis of time of purchase rather than after the deal had been done eg check receipts, call garage before parting with cash or when paying write on the receipt that you're buying a car with a forged engine rather than sold as seen.

depends how long youve had the car, whether or not id chase it up

having said that - not really got anything to loose

first port of call would be a surprise face to face visit with who you bought it from.
