Speeding advice

Default Speeding advice

I appreciate this is a bit of a lame question to some people but I could do with some clarification before I admit any form of guilt.

I know some people will say "speeding is speeding and if you're exceeding the speed limit you can be prosecuted for it" but is this correct or is there truth in the urban myth of "you are allowed speed limit plus 10% plus 3mph)?

If the additional allowance is true, this would make it:-

30mph limit = >36mph you will be prosecuted.
40mph limit = >47mph you will be prosecuted.

etc, etc.

The reason I ask is that I've been flashed doing 35mph in a 30 zone. I know I'm probably banged to rights but worth canvassing opinion (particularly if there are any fellow scooby owners with an intimate knowledge of the law )

Wait for the letter to come through the door before acting would be my advice.

ACPO association of chief police officers, has a recommended prosecution level of 10% + 2 mph.

The point is, its only a guidance note. You can be prosecuted for 31mph. If the camera went off at 35 mph, expect a NIP in the post. This must be served within 14 days of the alleged offence.

With an offence so trivial, and if you receive a NIP, you could write to the Scammers and see if they will offer a speed awareness course. Should cost the same but with no points.

If you have points already on your license then a course might not be offered to you.

If you get a letter then your getting prosecuted, almost always within two weeks. What your stating above is more at the officers discretion i believe. I don't think there is much you can do if the letter arrives other than pay the fine and take the points.

I got caught doing 39 in a 30 and I was given the option of a speed awareness course. There were people on the course that had been caught doing 34 so you might be unlucky but the course isn't so bad.

There's a chance camera was out of film, I got flashed a few years ago and nowt came through in the post

Ok thanks. The letter states 35mph which is a gutter, especially as I knew the camera was there and let the car's speed scrub off using engine braking rather than applying the brakes, that'll teach me for assuming it wouldn't go off at the 32-33mph I thought I was doing (which obviously I wasn't)
