Urgent, Log Book Question
Here is my problem and I'm looking for some advice asap.
A family member of mine bought a P1 for her boyfriend when they met a year ago(silly cow) but anyway they have finshed for good but she stupidly put the car in his name.
Does she have any leg to stand on in getting the car back because there is no way he is going to sign the car back to her.
So he's going to be able to walk away with a £9000 P1, Great for him but leaves my auntie in debt. Her own fault I know but love is blind.

The name on the V5 is the "keeper" and not the person who has legal title over the car, It depends on if your Auntie "Gifted" the car or not. Legal advice required here I'm afraid.

Well if your auntie bought the car and her name is on the V5 or if she has the original bill of sale to her, I would be inclined to report the car as stolen The ex won't be able to prove ownership if he gets stopped.

A vehicle needs to be of good title it means the owner has the right to sell it or use it and that the vehicle is not subject to any third party ownership rights. In this case the owner would need to be confirmed between the two parties, if the car has been gifted i.e. given as a present the car is now owned by the other party. If the car was registered as it was easier to do, e.g. you aunt had another vehicle or did not drive the car frequently then car ownership is in doubt the V5 and ownership are not the same thing.

If you look on the v5 it says that the registered keeper is not nesiscerely the legal owner (small writing under section 5). I had a similar dilema a while ago. Surely she will have an account to show where money came from and this should tie in with when car was bought. If he was a decent guy he should do the right thing... Check any v5 doc and you will see this under sec 5...
