Just had rear ended damn women! insurance questions
As above got rear ended this morning.
The damage, is bumper bent right in, boot and rear door dont lign up to close anymore, managed to get the boot closed kicking it while slamming it, but the rear door wont proeprly close it overlaps slightly.
the car is a 1995 import. however looknig at the insurance my girlfirend got me online it says 2003 lubaru legacy. only just pulled the documnets out and was gutted
Shes just told me she went on go compare, put in the reg and those are details it came up with. ive just checked and when you put in the reg is only pulls up details of this car 2003 legacy etc..
The crash wasnt my fault, do you think its a write off, and what is likely to happen with insurance. never made any claims before

This is a mess, you are not insured as it is your responsibility to ensure the details are correct, you would need to speak to someone legally if it is ok to forfeit the claim. The alternative and this is a very long shot is to see if the woman’s insurance co are going to admit fault and see if they will make a settlement claim. Another option fix the car yourself assuming its possible and then get the correct insurance, be aware that at this age the book price is very low so you may get very little back.

My sympathies as my Type R was smacked in the rear (twice in 2 days) although the driver allegedly wasn't distracted (at about 10mph )
My car has been collected and I was told the engineers will make a report and comeback to me, expect the same may happen to you.
As for insurance details problem can't help you sorry

yea could be. not sure why its coming up as a legacy..
we were in slow moving traffic, and she slammed in the back of me, no witnesses, but theres no real way she cant say its her fault. she said sorry a few times after she did it aswel

What does the V5 say?
What do you value the car at? Sounds likely to be a write off.
Do you have any independent witnesses?
In my experience, no matter how apologetic the guilty party is at the scene, they will soon change their story and try to blame you. "You braked too hard, your brake lights weren't working, you indicated then didn't turn, you pulled away too slowly etc."
The insurance company doesn't want a protracted fight so they try to agree knock for knock. Both parties lose no-claims.
Prepare for the worst and it will only be a bit worse than that

havnt received the v5 yet
insured the car before i went to pick it up, and hadnt really thought about it since.
there were no witnesses unfortunately
i reckon the car is worth about 2-2500k. it had a rebuilt engine at cost of 2300, tracker, toad cat 1 alarm, blitz nurspec r, jsut had a new clutch and was totally mint other than that.
Really worried about what insurance is going to say now. Theyre coming to pick it up tomorrow and drop off a courtesey car.
Ive also got whiplash..
it is a right mess like already mentioned.
but preparing for the worst

This is the problem with websites that you just type your reg into. If the DLVA have registered it wrong (WRX as GL is the classic example) then it is down to you to make sure the correct vehicle is insured.
In theory you should still be covered (being a non-fault accident). But they might still try to get out of the claim.
Just think yourself lucky that it isn't a fault claim, and that the other person is insured.... or you'd be screwed.

No comments on the insurance mess but hope and imagine you should be able to get it sorted.
As for the car, I'd say a right off, by the time you repair a rear end, 2 rear quarter panels, boot, spoiler, rear lights etc etc and add in the labour its just not worth it, they would also not take into account the new engine, blitz etc.
One option is to agree a settlement which includes you keeping the car and aslong as it is classed as an economical right off you could try and repair on the cheap by getting second hand parts (not seen the damage so only summizing) to get her back on the road, if it starts needing a jig etc then your probably best to cut your losses.

Never reply on just a registration number to obtain insurance, my company find that 9/10 imports are registered incorrectly. We even find that some UK cars are registered wrongly.

I'm not sure that the woman's insurance group can wriggle out of this one if they admit liability.
Say for example you had declared the car SORN / not insured and it was in the garage being mended and the woman had lost control and crashed through the garage doors totalling the car. She would still be liable for the damage to the car even though it was not insured.
Surely the issue about insurance does not alter the fact she was negligent and damaged your car. Plod might be a bit miffed though.

luckilly for you she has admitted the blame......
when it happened to me the chap a the scene admitted his fault
but not long after he said part my fault as i had overtaken him too
close to a junction even though it wasnt
no witnesses a wrecked scoob which they it wrote off, it had just come from a.p.i had engine overhall which cost 3.5k
had whiplash, took nearly 3years to sort out had to take 50/50 in the
end.
