ADVICE NEEDED ABOUT WHEEL CLAMPING PLEASE
Hi
my mates scooby has been clamped as he forgot to pay 1 parking ticket when his mrs was giving birth and now apparently the baliff company want £400, ticket fine, interest and the clamping fee
Anyway i am just about to pop over and help him take it off without damageing the clamp, is this illegal? also what do we do with the clamp once its off?
would appreciate any advice asap as dont fancy a night in the cell

AFAIK it is not illegal to remove the clamp, as long as you dont damage it. There was a thread somewhere about clamping being under contract law, and seeing as you didn't sign a contract it makes the whole process of clamping illegal, but i'm not sure how much i'd believe that.

AFAIK it is not illegal to remove the clamp, as long as you dont damage it. There was a thread somewhere about clamping being under contract law, and seeing as you didn't sign a contract it makes the whole process of clamping illegal, but i'm not sure how much i'd believe that.

The last time I got clamped the lock got angle grinder rash followed by the whole lot being put in skip! if you can remove clamp with no damage fine just leave it where it is no problem dont leave your prints !!!

Stevio that site does not tell me if i am performing a illegal act or if i can happily remove it? this is the real answer.......got a hour anf 3 minutes before i am due to be at his house

hmmm if they work for the council i think it may be an offense to remove it? but at the same time they can not over charge you. have you rang the number provided and is there sign posts ect stating they will clamp? as by law they need to give warning to clamp you.

He called the company and council and both have demanded £400 as ticket has been outstanding since march

hmm well sorry m8 i really dont know, you could ring up the sia agency and just ask them, or some other over seeing clamping company! sorry cant be no more help dont want to say its legal and get u in trouble

I removed one from my old polo a few years back with no damage,just left it where it was and took a picture to prove there was no damage. heard nothing from it, that was over 4 years ago now.

as Terminator x has said.its what ive done aswell ive got it of with my angle grinder wich is kept in boot with gloves,glasses (for work purposes of course) drove away and ignored any letters,threats for court action as the fine is not legally valid . its just a load of b***ocks made up by the company who got clamped by.

GOOOOOOOOOOOOOOOOOOD morning guys an gals and you will be pleased to hear that i did not spend the night with pc plod
After a 2 hour battering we managed to get the clamp off and put everything back on...IN THE DARK!!!!
Now we have called the Baliff company and told them someone has taken it off (undamaged) and placed it in my mates front garden, when they asked who and when he simply goes ......A ANGEL
Car is now in my garage and we are waiting for the Baliff to come pick up his clamp......lady on the phone did say they will report this to the cops so not sure if i should bleach the clamp and my hands or if she's just trying to get us worried

FYI I carry bolt cutters in my car for this very eventuality

To the OP.
The problem here is the parking fine is still unpaid. If it is a fine issued for an offence on the public highway then it is legally enforceable so you now need to make an offer to settle it so you are fully in the clear. Just my 2 cents worth.
