ADVICE NEEDED PLEASE
Hi chaps, bought a scoob from a dealer on 21th march 2011
drove home steady no thrashin etc parked it up the next day 22 march 26 hours later first time started car from cold engine knocking and bad rattle when revved ! had advice from few specialists basically needs engine rebuild.
i contacted dealer the next day basically told me was fine when left garage
ive contacted consumer direct etc told me to do rejection letter which sent and he has acknowledged he basically says he knows his rights so no money back and he can do a repair ( second hand engine ) £1100. Told him not interested and i will go thru small claims for full refund or i would accept a repair but from a specialist. spoke to dealer again today he now says if it goes to court he will only be told to repair the car which he will do cheaply ! and he will not have to refund me the full price! Anybody had similar situation or know how outcome will go.

Did you get any warranty with the car? As I think it's law for a dealer to provide at least 6 months warranty! I may be wrong though.
Every car I have bought from a dealer I have had either a 6 months or a year.
Hopefully someone can give either confirm my thoughts or correct them.

They have to give a 3 month warranty by law and its well within that time so the dealer either has to repair to the original standard or take the car back.

He has offered a repair but by his mechanic and it would be a secondhand engine ! which i am not interested in, my concern is that if i go to court he will still only have to repair it which will be his cheap way !

With what you have wrote I'm assuming it's a 'trader' and not a dealership.....either way who is it ? Someone might know of them and they could be ok or vise versa bunch of wan kers

He can use who he likes to repair the vehicle, it's his choice.
My father was a trader and a few years ago sold an Impreza to a young lad. 2 months into ownership the car went bang. No fault of my father or the new owner, just one of those things. My father agreed to have the car repaired at the garage he used for all his work. The owner wanted a Subaru specialist to do the work. So my father and new owner agreed that my father would contribute 'X' amount of money and the new owner would pay the rest.
I think from memory my father paid £1300 plus he paid for the car to be transported. The new owner then paid the rest of the bill to the Subaru specialist that was used.
Maybe that's an idea to throw at the dealer, not ideal but if you want the work done by a certain company then that's the only option.

Its crazy i know but what if a dealer sold somebody a car and the new owner took it on the track. Ragged the nuts off it and blew it up on the first day. Would you expect the dealer to refund him ????. The dealer has no idea what happens to the cars when they leave his forecourt in all fairness.

No dealer in the country would offer full money back and no small claims court would force the dealer to pay up. Its just how it is buddy.
In this instance the OP has not done anything wrong to cause his car to pop but this isn't the case with every car that goes wrong soon after buying it. The dealer or the court have no idea how the car was treated after it left the showroom.
For all they know the car was taken to the nearest race track and driven flat out lap after lap. We know it wasn't but thats not the point.

A lot of people buy from a dealer on the pretence that they have more peace of mind than buying private,but the truth is they have no more peace of mind than buying a motor from the side of the road from one of our many Eastern European friends that frequent this fair isle?..

warranty is repair or replace and in that order, they DO have to do that but they can use any garage they like but i dont think they can bodge it with second hand parts as that is not a repair but a temp fix
