My username is not a registered trade mark....ive searched UK companies house and the U.K Patent Office.....it's only a username for a forum site....what's the big deal....get a life !

it makes no difference what is registered.

If tere is a reputation under the name scoobysport (be it good or bad ) then you can be done for passing off, so long as misrepresntation and damages can be proven as well as likelihood of confusion.

Passing off is a tort unlike infringement of trademarks which is specifically protected by the 1994 trademarks act.

Either way, I wouldnt worry, as you arent selling anything, so no damages, nor misrepresntation can occur.

There is no copyright in a name so you dont even infringe that, so over all, take a chill pill, and knock yourself out.

I know it wasnt asked for but this advice is free, so I can plead all the usual disclaimers etc, despite being qualified to answer .

The above point is exactly right, i only posted this because i got emailed by the mediator of this site....i'm not pretending to be anyone special just a user of an interesting site that i'd like to take part in...

P.S Yep i do have a Subaru Sport... oh dear i've used the word Subaru...is that an infringement of rights..etc ?

Err.. don't know much about the legalities of this, but it seems to me that you're not breaking any rules or infringing any copyrights or trademarks....

...however Scooby Sport (the company) is a long time supporter of this BBS and it's their support (along with many others) that helps keep this excellent site free for the rest of us.

While your username may have nothing to do with Scooby Sport the company and everthing to do with the type of car you drive, maybe it would be a nice gesture to change it anyway...

Only my opinion..

to be fair guys it isnt really fair, and I think as a gesture of good faith you shouldnt do things like that.

There is always going to be a likelihood of people believing you are connected, so all you are doing by using that name is potentially misleading other bbs members.

Which inturn will make you appear to be dishonest.

since there are an infinite number of possible names you can choose, surely it would be nicer to do the decent thing and use another?
