109.8mph on the m40 stopped by video car
its not me its a friend from work.
he,s already got 6 points in the last six months,
whats he likley to get-hes only been driving for two year
any advice for him?

Honestly?
The bus pass route is almost a serious one.
6 points 6 months ago, now 40 mph over the speed limit ... the magistrates recommended penalty scale would say 6 points for the current offence, which means disqualification on totting up.
Disqualification on totting up now carries a 6-month recommended ban, which is what I suspect your friend will get, unless he can show that he'll lose his job as a direct consequence.
Essentially, the magistrates will look at your mate and think that the first 6-pointer clearly hasn't taught him a lesson.
I hope for his sake that he gets legal representation.

My 2 mates got caught together doing 106.7mph on A38 on his R1 bike
one of them got 3 points £200 fine + 28 day ban
The other got 21 day ban and £400 fine
They were both caught at same time but different results from the court ???????

he definatley needs a brain transplant!!
insurance wont be a problem(company car)
but a lengthy ban will lose him his job, just found out that the police have put on his report that his brake lights were on when they recorded the speed ,implying he was traveling faster, will this go against him (surely they can only do him for the recorded speed)

As far as putting in their report that his brake lights were on, what they are doing is painting a picture for the magistrates.
If they were to say it was over 100mph it wouldn't sound anywhere near as bad as it was 100mph but he was slowing and at the time in had been raining and there was heavy traffic etc etc etc.
If as you say the offence was caught on camera he is best off pleading guilty straight away. If he pleads not guilty for whatever reason the Police will show the video in court and he will be completely buggered.

His licence will be revoked by the DVLA anyway:

If you incur penalty points in the two year period immediately following your first successful driving test, and your penalty points add up to 6 or more ( including any that were incurred within 3 years of the latest conviction) your licence will be revoked by DVLA. You will then have to obtain a provisional licence, drive as a learner and pass the theory and practical test again in order to regain your full driving licence.</I>
He needs to be getting his bus pass.......

Sorry but I'm with Banshi.
Has he thought about finding someone who is unemployed but drives a little closer to the speed limit who would be more than happy to drive him around whilst he is banned?
Someone who has semi retired etc may be grateful for £20 in his pocket on a daily basis and it might saves your mates job.
