Default EBAY WARNING!!!! READ!!!!

Hi Guys

Due to my own experience on ebay i feel this is needed to be shared with all subaru owners and car owners in general. i recently bought some sti heads off ebay and have been ripped off. they supplied me with wrx heads and have done this before to a guy on here Tucker. DO NOT BUY ANYTHING OFF THIS GUY!!! i have included the comms between him and myself trying to sort this dispute for your attention so you know what to expect if you do.

READ FROM BOTTOM TO TOP NOW

CHEERS

leewhataz1983 17-Aug-08 at 12:16:07 BST

too damn right i am. and i will be contacting my bank to recall the payment to you. and this whole communication will be gettin posted up on ebay, scoobynet and google also to show what a skank you are!! i give you the info your after and who cares what price they go for? are you a scoob dealer?
ebay is a place where you find bargains so price doesnt come into it. you clearly set out to do this as i am the second person and after i give you the info u wanted now your tryin to get out of it

rudy85_2005 17-Aug-08 at 12:09:03 BST

your right this has gone on long enough so i think if you are not happy which you clearly aint you should take this further with ebay!

rudy85_2005 17-Aug-08 at 12:07:44 BST

my point is you make a big point about being ripped off but when you look at objectively you have not been ripped off at all, and if you went to a garage and asked for what price they go for , you'd know this yourself. i currently am selling similar heads which have been stripped off a WRX engine and i
am selling them as such so i guess that invalidates your saying " if his selling them on a regular basis we should warn everyone on scooby net"!

leewhataz1983 17-Aug-08 at 11:48:16 BST

i am sorry but i have not done anything at all with regards to your charactor. i posted up the sale page asking for people's expertise about the heads and a guy called 'tucker' posted a comment with regards to a sale from you. nothing to do with me but i feel you should be aware this is at least the
2nd time this has happened

Can you please explain what you mean about getting a price for sti
heads from a garage? i do not understand what you mean or what that really has to do with anything.

rudy85_2005 17-Aug-08 at 11:40:45 BST

well thank you very much for defaming my character on a scooby forum, cheers. you go on like you've been ripped off , but have you actually gone to a garage and asked for the price of the Sti heads i sold you? And i cant check that link to verify my feedback as that "supposed" member has not sent me any emails of complaint.

leewhataz1983 17-Aug-08 at 11:06:05 BST

'UP FOR SALE I HAVE A PAIR OF SUBARU IMPREZA WRX STi 96-98 CYLINDER HEADS'. that states to me that you have a pretty good idea what they are? i trusted that not the part of what car they were removed
from. also i believe you should check out this link to see about your feedback

https://www.scoobynet.com/general-te...sti-heads.html

this back and forth has gone on long enough i think you'l agree. i've given you the info you requested. can we settle this

regards

rudy85_2005 17-Aug-08 at 10:49:49 BST

Also with regards to you buying them in good faith i also sold them to you in good faith and my feedback supports this. i have had no complaints from buyers. my listing does highlight that they were REMOVED from a 96 STi engine.

regards

leewhataz1983 17-Aug-08 at 10:40:56 BST

what do you mean i cannot compare it to that? it was advertised incorrectly. advertised as sti and they are wrx. i bought them in good faith that they were sti. it is very hard to tell by pictures alone and bought them judging by your feedback that you were an honest seller. now you have received the information you have asked for i can't understand why you are making this so difficult. the sale and description is your responsibility. not mine as a buyer

rudy85_2005 17-Aug-08 at 10:40:44 BST

you've stated in your last email i quote "the fact that your friend removed them from an STi car does not guarantee that the part is STi", for arguments sake if this was true then surely it is your right as the buyer to further enquire about the item and its techinical details? Usually when iv sold heads
in the past, buyers ask me these questions prior to purchase. you merely asked whether they were skimmed or pressure tested which has no bearings on whether they are sti or not?

regar

rudy85_2005 17-Aug-08 at 10:28:47 BST

you cant possibly compare buying a 2.0litre engine and being provided with a 1.6 the same as buying cylinder heads. if i had advertised STi heads from a 2000+ model than maybe but your talking about heads removed from a 95/96 sti.ALso if the item was "significantly" different from what i sold you
than surely you would have known this prior to purchase, and if not you should have enquired about the shims, cams etc ,things which you are claiming to be different from the wrx??

leewhataz1983 17-Aug-08 at 08:03:47 BST

you asked for the technical information which after finding i supplied you with immediately. the reason i should get a refund is that they are not sti as advertised in your listing. the technical information i provided you with proves this as it matches the heads you sold me. the fact your friend
removed heads from an sti car cannot guarantee the part is sti. if you bought a 2 litre engine and you were provided with a 1.6 you would expect a refund and this is no different?? thanks

rudy85_2005 16-Aug-08 at 22:51:17 BST

sorry for the late reply . you've stated that these heads are not from an STi engine however that is subjective , in the last week iv witnessed a friend strip the heads off a version 2 ( 1996) subaru impreza Sti and those heads are exactly the same as the ones i have sold you. so i dont see why i
should refund you? And in my listing i have not offered a refund poilicy and only in exceptional circumstances would i offer a refund.

regards

i totally agree. there should be a name and shame part on scoobynet for this type of thing unless i've missed it somewhere. i would advise that there are genuine sellers on ebay dont want to just slag off ebay but i think people who do this deliberately should not get away with it. needless to say i have put in an official complaint on ebay

must say i think i did everything i could with this guy. the word worm comes to mind!!!

Did you use your credit card for payment through paypal?
Because if you did you can claim your money back through either your credit card or paypal
Because the item is not as described
If he does not refund your money paypal will take it on your behalf and fine him for doing so.

E-bay and paypal worth a try but they don't really work hard for their money though!

Default small claims

you are quite right pursuing this issue through the courts. be quick though as he may disappear or change his company name. good luck.

Have you filed a dispute with ebay?
Because if he has sold you items that are not as described, they will cancel his ebay account if he dont re-emburst you.

He is out of pocket £290
Also the chap selling has been a member for just over 2 years, Has 200+ pos feedback and only 1 neg
He also has alot of item for sale so i would assume he would not want his account frozen
Take up a dispute with ebay and do not back down, avoid the petty small talk and threats, just stand by, the item is not as described!

Remember if/when you post them back, pay a little extra and send them recorded, just so you have proof of postage, that way he cannot skank you saying you have not resent them.

Good luck mate, do not let him get away with it!

another good idea , would be to go to a subaru specialist and get them to state that the heads are not sti ones , then u got it in black and white fella , then he cannot argue with that ,

also i will keep u posted as to what the blokes says to my mate if he returns the message my mate sent , which was rather funny

Good luck in getting this sorted, I hope you get your money back, but more importantly I hope that people like this don't get away with it. It's obvious from his responses he know's he's in the wrong, and even though he may not have done this deliberately, he should have admitted his mistake and refunded you.

I'll be polite and not use the words I want to!

well heres a lowdown of my mates run in with this tw@t

enjoy....
Dear rudy85_2005,

i no longer wish to have this item, as i have noticed a thread on 3 forums regarding issues with sellers and you, and i would not like to take a chance on something that mite not be what it states it is , as id rather have unpaid item strike than be hundreds out of pocket

- thamesirons76

Dear thamesirons76,

well its very interesting that you send an email immedialtly after purchase and today of all days? incase you didnt know i had a dispute with one ebay member which i question is hiding behind the facade of "thamesiron76". i'll let ebay handle this

- rudy85_2005

then 2mins later he got this

Dear thamesirons76,

ALso i could offer a 7 days money back gurantee on the heads but i know that will make no difference on your decision as you are obviously connected in some way to the malicious ebayer i had a dispute with.

- rudy85_2005

Dear rudy85_2005,

i am no involved in whatever is goin on , my boyfriend asked me to bid on them as he was looking at them last nite , he went to look at a set this morning and they was no good he called me when he was a he was at hes friends and said to purchase your items , and within 5-10mins he called me back to say dont bid on them as there was some sort of issue with you and a couple of scoobynet.co.uk users, i told him id bought them, and he explained to me what had happend and as a subaru owner myself bad things travel very fast , and the accusation that i behind is so far from the truth,i wouldnt be sad enuff to spend my time being as you o nicely put it at as 'malicous', im just doing what my boyfriend asked, and i have also read the emails you have sent ,the person in question , and the way that you have treated him is absolutly awful, as you put it 'sticks and stones' scoobynet has got 26.000 members and it is not the sort of place you want to make enemies ,

- thamesirons76

Dear thamesirons76,

im really quaking in my boots. As far as im concerned my communication with you is terminated. i suggest you get over it , i sold subaru cylinder heads in good faith.

- rudy85_2005

Dear rudy85_2005,

u sold the wrong subaru heads to the fella , i will get my friend to post up this reply from you, you sold the wrong item to the bloke and from that what you have said you are the **** with the problem , why should i trust we are buying as that might not be what it states it is ,

i am so so so glad i posted this up as at least i know i have helped one person. and would anyone really trust a 7day money back guarantee with this guy after the comms we have all seen? just so you all know there is a distance marketing directive which covers us all through buying items through ebay but it does involve going to a small claims court which can be a long drawn out process. if anyone gets into trouble like this make sure you take copies of any advertisement and messages and try not to speak on the phone as anything like that cannot be proved in court. a ruling doesn't generally get made until the defendant hasn't shown up 3 times (which i'm guessing this guy will do) but it just goes to prove i hope people follow my example and post up and bad experiences and pass them on. i am in the darlington scooby club and have informed all my fellow members and hope you all do the same if you are in any clubs.

Scooby net actually has 85.000 members, am i right in thinking it is proberly 1 of the biggest scooby forums if not the biggest?

I'd love the bloke to read this thread and see what he has got him self into, with bad advertisment like this its bound to affect his sales on Ebay

I have briefly read the thread and the Ebay link.
Where does it mention on the listing that they were from an STI?

DIFFERENCE BETWEEN THE JAP SPEC AND UK SPEC IS YOU GET MORE POWER FROM THE JAP SPEC FOR THE ULTIMATE STi EXPERIANCE!!!

If this isnt saying they are sti heads what is??

What a wan ker. I agree a name and shame section for ebay would be very handy. quick look would see peoples experiances

The sooner we get jokers like this off Ebay, the better for everyone involved I say. Fair game to the O.P. for taking it further. I would be doing the same.
